Estimated Win ProbabilityModerate Fit

This tender for Viru Prison construction and reconstruction requires meticulous adherence to security protocols and a highly competitive price. A winning strategy will focus on demonstrating robust security clearance processes, efficient project delivery, and a cost-effective approach, leveraging experience in similar secure environments.

Key Winning Messages

Uncompromising Security and Compliance: Demonstrating a flawless understanding and execution of stringent security protocols, including background checks and site access.

Cost-Effective and Efficient Delivery: Presenting a highly competitive price while assuring timely completion and optimal resource utilization.

Proven Expertise in Secure Environments: Highlighting relevant experience in similar institutional or high-security projects.

Key Opportunities
The tender explicitly states 'competitive price offer, as tenders will be evaluated based on the lowest price without taxes.' This presents a significant opportunity for bidders who can optimize their cost structure.
The requirement for background checks and subcontractor vetting can be framed as a strength, showcasing a mature and responsible approach to security.
While not explicitly stated as an evaluation criterion, demonstrating experience with 'roostevabast materjalist wc pottide tarnimine, paigaldus' (supply and installation of stainless steel toilets) for Part 1 and 'vastupidavus ja kauakestvus' (durability and longevity) for Part 2 can differentiate a bid.
Key Challenges
The absence of specified evaluation criteria (other than price) makes it difficult to optimize the bid beyond cost. Bidders must assume price is the dominant factor.

Focus intensely on cost optimization and ensure all mandatory requirements are met flawlessly. Avoid any ambiguity or potential for disqualification on technical or eligibility grounds.

The security clearance process for employees and subcontractors can be time-consuming and may impact project timelines if not managed proactively.

Initiate the background check process for all proposed personnel and subcontractors immediately upon tender submission or even pre-emptively for key individuals. Have contingency plans for personnel replacement if clearances are delayed or denied.

The tender is for a prison, implying a need for strict adherence to security protocols and potentially limited access for site visits and work, which could increase complexity and cost.

Thoroughly review the 'Proposal Submission Suggestion' for detailed site visit instructions and confidentiality requirements. Factor in potential logistical challenges and security overheads into the pricing.

Ideal Bidder Profile
A construction company with proven experience in government or correctional facility projects, possessing a strong track record of security compliance, efficient project management, and a demonstrated ability to deliver projects within budget and on time. Experience with specialized materials like stainless steel for sanitary facilities and expertise in perimeter security systems would be advantageous.
Key Requirements
Mandatory background checks for all employees and subcontractors accessing the site.
Fulfillment of all exclusion grounds and qualification conditions via ESPD.
Submission of CVs for key personnel (Project Manager, Site Manager, Heating Specialist) with specific details (birth date, certificate number).
Acceptance of all tender requirements and draft contract conditions (Appendices 2).
Competitive price offer, evaluated based on the lowest price without taxes.
Mandatory site visit/familiarization.
Subcontractor qualification and compliance with exclusion criteria.
Key Discriminators
Demonstrated experience and established processes for rapid and successful security clearance of personnel in high-security environments.
A highly detailed and transparent cost breakdown that clearly demonstrates value for money and efficiency.
Proactive risk management plan specifically addressing security, access, and material procurement for a correctional facility.
Social Value Opportunities
While 'Social Aspects: No' is indicated, consider a commitment to employing local labor where feasible, especially for less specialized roles, and ensuring fair labor practices throughout the supply chain. This can be presented as an added value beyond the explicit requirements.

Good

Tender Quality Score

This tender for Viru Prison construction and reconstruction works demonstrates good clarity and data consistency, with a clear lowest-price evaluation criterion. However, significant concerns arise from restricted access to tender documents and a potentially too narrow CPV code, impacting fairness and legal compliance.

Score Breakdown

Legal Compliance75/100

The tender generally adheres to legal requirements, including reasonable submission deadlines and clearly defined procedure types. However, the assigned CPV code (Piirete paigaldamine - Fence installation) appears too narrow for the extensive scope of construction and reconstruction works described, potentially limiting visibility to relevant bidders.

•CPV code is too narrow for the described scope of work.
Clarity85/100

The tender description for both parts of the project is clear and unambiguous, detailing the scope of work effectively. AI-extracted requirements are well-structured and understandable. The evaluation criterion of 'lowest price wins' is explicitly stated in the relevant document, contradicting the automated flag.

Completeness80/100

Most essential information, such as title, reference, organization, deadlines, and estimated value, is provided. Requirements and evaluation criteria are defined. However, the contract duration is not explicitly stated in the main overview, and the NUTS code is missing. The automated flag regarding missing location info is incorrect as 'Viru Vangla' is a specific location.

•Contract duration not explicitly stated in the main overview
•NUTS code missing
Fairness50/100

The tender raises significant fairness concerns due to the explicit mention of 'restricted access information' within the tender documents, with access limited to undertakings meeting specific requirements. While the evaluation criteria (lowest price) are objective and e-procurement is enabled, this restriction could potentially disadvantage some bidders or favor incumbents.

•Restricted access to tender documents
Practicality65/100

Electronic submission is supported, enhancing practicality. However, the contract start date is noted as presumptive and without legal meaning, which can create uncertainty for planning. A mandatory site visit is required, which is practical for complex works but demands bidder effort. The lack of a clearly specified contract duration also impacts practical planning.

•Contract start date is presumptive
•Contract duration not clearly specified
Data Consistency70/100

The tender exhibits good data consistency for most key fields and dates. However, there's a minor inconsistency with 'Value Classified: Yes' despite the estimated value being disclosed. The CPV code's narrowness also presents a consistency issue with the broad scope of work.

•'Value Classified: Yes' despite value disclosure
•CPV code too narrow for scope
Sustainability50/100

The tender explicitly mentions 'Green Procurement' and includes 'energy efficiency' in the description for one part of the works, which is a positive aspect. However, it lacks specific social criteria or an innovation focus, and it is not indicated as EU-funded.

•Lacks explicit social criteria and innovation focus

Strengths

Clear and detailed description of works for both parts
Objective and transparent evaluation criteria (lowest price)
Electronic submission and e-procurement enabled
Comprehensive AI-extracted requirements
Explicit mention of Green Procurement and energy efficiency

Concerns

Restricted access to tender documents, impacting fairness
CPV code is too narrow for the full scope of works
Contract duration and definitive start date are not clearly specified in the main overview
Mandatory site visit and background checks add complexity for bidders
Lack of explicit social criteria or innovation focus

Recommendations

1. Clarify the nature and justification for restricted access information, ensuring transparency and equal opportunity for all potential bidders.
2. Review and update the CPV codes to accurately reflect the comprehensive scope of construction and reconstruction works.
3. Provide a clear estimated contract duration and a more definitive contract start date to aid bidder planning.
