Original Tender Description

The subject of the procurement is the preparation of an analysis of secure data processing environments. With the entry into force of the EHDS regulation (Regulation (EU) 2025/3272), the organization of secondary use of health data will become Union-wide. The regulation stipulates that electronic health data may only be processed for secondary use purposes in secure processing environments (SPE), which meet strict technical, organizational, and interoperability requirements. The requirement will apply in 2029. The analysis, which is the subject of this procurement, will identify the applicable requirements, map potential environments, conduct a compliance assessment, develop a national concept for the organization of SPEs, and an action plan for its implementation with volume and resource estimates.

Good

Tender Quality Score

This tender for a secure data processing environment analysis is well-structured with clear technical requirements and a reasonable evaluation methodology. However, it lacks explicit details on exclusion grounds and social/innovation aspects.

Score Breakdown

Legal Compliance75/100

The tender appears to comply with general procurement regulations, including a proper CPV code and a clear procedure. Deadlines are reasonable, and there are no immediate indications of disputes or regulatory non-compliance. The mention of EU funding also suggests adherence to relevant directives.

Clarity80/100

The description of the required analysis is detailed, referencing specific EU regulations and technical documents. The evaluation criteria are specified, and the conditions for submission are generally clear, although some technical documents are referenced by codes which might require further investigation by bidders.

Completeness70/100

Most basic information is present, including estimated value, contract duration, and start date. Key documents like technical specifications, CV forms, and a draft contract are provided. However, the absence of explicit mandatory exclusion grounds and detailed eligibility criteria could be improved.

Fairness85/100

The tender promotes fairness by disclosing the estimated value and using an objective evaluation criterion (best price-quality ratio). Access to documents is provided, and e-submission is mandated. The requirement for bids in Estonian is standard for national tenders, and there are no obvious signs of tailoring to specific companies.

Practicality65/100

The tender mandates e-submission and e-procurement, which enhances practicality. A contract start date is specified. However, financing information is not explicitly detailed, and the duration of 4 months for a complex analysis might be tight depending on the scope.

Data Consistency90/100

Key fields such as title, reference, organization, value, and deadlines are populated. There are no indications of suspension or disputes. The dates provided for reveal, submission, opening, and contract start are logically sequenced.

Sustainability50/100

The tender mentions 'Green Procurement' as a characteristic, which is a positive indicator. However, there are no specific social criteria or innovation objectives detailed within the provided text. The EU funding aspect contributes to a moderate score.

Strengths

Clear technical requirements linked to EU regulations
Objective evaluation criteria (best price-quality ratio)
Mandatory e-submission and e-procurement
EU funded status

Concerns

Lack of explicit mandatory exclusion grounds
Limited detail on social and innovation aspects
Potential tightness of the 4-month contract duration

Recommendations

1. Explicitly list mandatory exclusion grounds for clarity.
2. Incorporate specific social and innovation objectives to enhance sustainability.
3. Provide further justification for the 4-month contract duration if it is indeed sufficient for the scope.
