Original Tender Description

The objective of the contract is to carry out design and construction works for the energy-efficient reconstruction of the Mustvee School building and the education center building on time and at optimal cost, in accordance with the technical description and the prepared preliminary project. The duration of the design-construction works is 21 months from the conclusion of the contract. The public procurement will be carried out in two stages: Stage I is the submission of applications and qualification of applicants, and Stage II is the submission of offers and, if necessary, negotiations with bidders. NB! Pursuant to § 81 (1) of the Public Procurement Act, the contracting authority may amend the procurement notice or other tender documents in a competitive negotiated procedure BEFORE the deadline for submitting applications. Inquiries to amend the tender documents should be made in Stage I. In Stage II, the contracting authority may no longer amend the tender documents, and the procurement should then be started from the beginning. Technical details can be clarified during negotiations, to which all qualified bidders will be invited in Stage I.

Tender Quality Score

This tender provides comprehensive documentation but suffers from critical inconsistencies in evaluation criteria and an incorrect CPV code, significantly impacting its legal compliance and clarity.

Score Breakdown

Legal Compliance50/100

The primary concern is the incorrect and incomplete CPV code (5970 instead of an 8-digit standard), which is a fundamental classification error affecting tender visibility and compliance. The procedure type and deadlines are otherwise compliant.

•Incorrect and incomplete CPV code (5970)
Clarity55/100

While most requirements and descriptions are clear, there is a significant contradiction regarding the evaluation criteria. The basic information states 'relative_weighting,' but the specific evaluation document indicates the winner is determined solely by the 'lowest-priced bid.' This ambiguity creates confusion for bidders.

•Contradictory evaluation criteria (relative weighting vs. lowest price)
Completeness85/100

The tender provides a comprehensive set of 16 documents, covering all necessary aspects from technical specifications and forms to a draft contract. All basic information, deadlines, value, and location are clearly specified.

Fairness75/100

The tender promotes fairness through full document access, disclosed value, reasonable deadlines, and the 'or equivalent' clause for standards. E-procurement is enabled. The justification for not dividing into lots is reasonable. The contradiction in evaluation criteria, while primarily a clarity issue, also slightly impacts transparency regarding the bidding rules.

•Minor transparency concern due to evaluation criteria contradiction
Practicality85/100

The tender supports electronic submission and e-procurement, providing a clear opening place URL. The contract duration is specified, and financing information is indicated as available within the documents. The two-stage competitive procedure with negotiation is practical for a complex design-build project.

Data Consistency40/100

There are critical inconsistencies, most notably the conflicting information on evaluation criteria (relative weighting vs. lowest price). The CPV code is also inconsistent with standard 8-digit formats. The 'Value Classified: Yes' alongside a disclosed value is a minor inconsistency.

•Conflicting evaluation criteria
•Incorrect CPV code
Sustainability60/100

The tender explicitly identifies as 'Green Procurement' and focuses on 'energy-efficient reconstruction,' which is a strong positive. It is also EU-funded. However, it lacks explicit social criteria or an innovation focus, as noted by the automated checks.

•Lack of explicit social criteria
•Lack of innovation focus

Strengths

Comprehensive documentation provided (16 documents)
Clear two-stage competitive procedure with negotiation, suitable for complex projects
Explicit focus on 'Green Procurement' and 'energy-efficient reconstruction'
Electronic submission and e-procurement enabled, promoting accessibility
'Or equivalent' clause included, enhancing competition

Concerns

Incorrect and incomplete CPV code, impacting legal compliance and tender visibility
Significant contradiction in evaluation criteria (relative weighting vs. lowest price)
Data inconsistency across several key fields
Lack of explicit social criteria or innovation focus in sustainability aspects

Recommendations

1. Correct the CPV code to an appropriate 8-digit standard code to ensure proper classification and legal compliance.
2. Clarify and harmonize the evaluation criteria across all tender documents to remove ambiguity, explicitly stating whether it is lowest price or relative weighting.
3. Review and ensure data consistency across all tender fields and documents to prevent confusion and potential challenges.
