Original Tender Description

East Devon District Council Request the provision of works of resurfacing 1No. car park and 1No. park footpath as below: Phear Park is located in Exmouth (SY00735 81558) with vehicle entrance and exit access via Withycombe Road. Pedestrian access can be found via 2No. footbridges across Withycombe Brook to the north and footpath access from the southeast corner. The park includes an inner and outer circular footpath providing access to a playpark, skate park and Exmouth College to the north east. The footpath’s condition varies with severe rutting and scouring at the eastern portion, shallow scouring in the north and cracking due to tree root growth on the southern section. Therefore, requiring overlay and regulating surface course. ‘The Green’ Car Park is located immediately next to Victory Hall in Broadclyst (SX98330 97187) with entrance and exit access via Hellings Gardens leading to B3181. The tarmac surfaced car park is linear with bay parking lining along each border. Pedestrian access is available from the northwest and southwest corners of the site. The car park’s surfacing has areas of shallow scouring to the surface course and localised potholes towards the entrance of the site. Therefore, requiring overlay and regulating surface course.

Good

Tender Quality Score

This tender provides a clear description of the required works and basic timeline, but suffers from significant incompleteness regarding detailed requirements, evaluation criteria, and financial specifics, which could hinder fair competition.

Score Breakdown

Legal Compliance75/100

The tender defines the procedure type and CPV code correctly, and there are no reported disputes. However, the reveal date is missing, and the AI-extracted requirements indicate a lack of specific mandatory exclusion grounds and detailed evaluation criteria, which are crucial for full legal compliance.

•Missing reveal date
•Lack of specific mandatory exclusion grounds
Clarity60/100

The description of the works and locations is clear and unambiguous. However, the overall clarity is significantly hampered by the absence of specified evaluation criteria, detailed financial requirements, and comprehensive mandatory exclusion grounds, leaving bidders with insufficient information.

•No evaluation criteria specified
•No specific financial requirements mentioned
Completeness55/100

Basic information such as title, reference, organization, value, duration, and location is provided. However, the tender is critically incomplete due to the absence of detailed tender specifications, comprehensive eligibility/technical/financial requirements, and, most notably, evaluation criteria. The listed documents appear to be administrative rather than substantive tender documents.

•Missing comprehensive tender specifications/terms of reference
•Missing detailed financial requirements
Fairness50/100

The estimated value is disclosed, and electronic submission is supported, promoting equal access. However, the explicit absence of evaluation criteria is a major fairness concern, as it prevents objective and transparent assessment of bids. While requirements are not overtly tailored, the lack of detail could lead to subjective decision-making.

•No evaluation criteria specified, impacting transparency and objectivity
•Potential for subjective assessment due to lack of detailed requirements
Practicality70/100

Electronic submission is supported via a dedicated portal, and key dates like contract start and duration are clearly specified. However, a direct URL to the full tender documentation is not provided, and financing information beyond the estimated value is limited, slightly reducing overall practicality.

•No direct URL to full tender documentation provided
•Limited detailed financing information beyond estimated value
Data Consistency65/100

Most key fields are populated, and dates are logical. However, there is a significant inconsistency in the estimated value, stated as EUR 175,800.00 in basic info and £146,500 in a document summary. Additionally, the 'Liable Person' field is empty, and there's a contradiction regarding e-submission between AI-extracted requirements and automated checks.

•Inconsistency in estimated value/currency (£ vs EUR)
•Missing 'Liable Person' field
Sustainability30/100

The tender does not explicitly incorporate any green procurement, social aspects (beyond a general SME focus), or innovation criteria. This indicates a missed opportunity to promote broader sustainability objectives within the procurement process.

•No explicit green procurement criteria
•No explicit social criteria

Strengths

Clear and detailed description of the works and locations
Estimated value, duration, and contract start date are specified
CPV code is correctly assigned and NUTS code provided
Electronic submission is supported via a dedicated portal
Tender is indicated as 'Divided into Parts', potentially allowing for more flexible bidding

Concerns

Critical absence of detailed evaluation criteria
Missing comprehensive financial requirements and mandatory exclusion grounds
Lack of substantive tender specification documents; listed documents are administrative
Inconsistency in estimated value/currency between basic information and document summary
No explicit sustainability (green, social, innovation) criteria

Recommendations

1. Publish a comprehensive tender document package including detailed specifications, full eligibility and exclusion criteria, and an explicit evaluation methodology.
2. Clarify and reconcile the estimated value and currency across all tender documents to avoid confusion for bidders.
3. Consider incorporating sustainability criteria (e.g., environmental impact, social value, innovation) into future tenders to align with modern procurement best practices.
