Original Tender Description

This Preliminary Market Engagement (UK2) notice is being issued to inform the market that Yorkshire Water Services Limited is undertaking early engagement with suppliers to support the development of the sourcing strategy for a Direct Procurement for Customers (DPC) Programme Advisory Framework. Yorkshire Water is progressing a pipeline of major infrastructure projects for delivery using the Direct Procurement for Customers (DPC) delivery model. Under DPC, a competitively appointed provider designs, builds, finances and potentially operates major infrastructure assets under long-term contractual arrangements. DPC projects are subject to regulatory oversight by Ofwat, including staged regulatory submissions demonstrating strategic case, procurement readiness, and value for customers before contracts can be awarded. Yorkshire Water is therefore exploring the establishment of a multi-disciplinary professional services framework and/or strategic partnerships to support the development of bankable DPC projects capable of progressing through regulatory approvals and competitive procurement. The framework may provide support across several disciplines, including: Technical advisory - engineering, design, environmental assessment, ecology, planning and technical assurance; Commercial advisory - development of business cases aligned with the HM Treasury Five Case Model, procurement strategy, market engagement, commercial structuring, risk allocation, payment mechanisms and incentivisation structures; Legal advisory - development of robust contractual arrangements for major infrastructure concessions, building on previous DPC and infrastructure projects, including specialist support in planning and infrastructure law; Programme assurance - independent assurance of submissions and programme governance to ensure regulatory compliance and readiness for Ofwat/RAPID assessments and associated approval processes. The information gathered through this engagement will help shape the proposed scope, structure, commercial model and procurement approach for the framework. This exercise is for information-gathering purposes only and does not constitute a call for competition. Participation in this engagement will not provide any advantage or disadvantage in any subsequent procurement process. Suppliers interested in contributing to this market engagement are invited to express their interest in accordance with the instructions set out in this notice.

Tender Quality Score

This is a preliminary market engagement notice for a significant advisory framework. While generally well-structured, it lacks specific details on evaluation criteria and document content, impacting its immediate usability for potential participants.

Score Breakdown

Legal Compliance75/100

The notice adheres to general regulatory compliance by providing a CPV code and indicating a planning status. However, the absence of explicit mention of regulatory compliance for the tender process itself and the lack of a reveal date for further information are minor shortcomings. The deadlines are not flagged as unreasonable for a planning stage notice.

Clarity80/100

The description of the DPC Programme Advisory Framework and the required advisory services is clear and detailed. The purpose of the market engagement is well-articulated. However, the lack of specified evaluation criteria for participation in the market engagement itself is a point of ambiguity.

No evaluation criteria specified for market engagement participation.
Completeness70/100

Most basic information is present, including title, organization, estimated value, and contract duration. However, the crucial aspect of available tender documents is lacking content, and the absence of a reveal date for further information hinders completeness. The submission deadline is provided.

No document content available.
Missing reveal date for further information.
Fairness85/100

The notice emphasizes that participation in this market engagement will not provide any advantage or disadvantage in subsequent procurements, promoting fairness. The estimated value is disclosed, and the criteria for technical capability are outlined. The process is described as an information-gathering exercise, which is a fair approach for preliminary engagement.

Practicality65/100

The notice indicates a submission deadline and contract start date. However, it lacks information regarding e-submission, which is a common and practical method for such engagements. The financing information and contract start date are present, but the absence of a direct URL for documents reduces immediate practicality.

No e-submission method specified.
No direct URL for documents provided.
Data Consistency90/100

Key fields such as title, reference, organization, estimated value, and contract duration are populated consistently. The dates provided (submission deadline, contract start) are logical in sequence. There are no indications of suspension or disputes.

Sustainability50/100

The notice does not explicitly mention any green procurement, social aspects, innovation focus, or EU funding. This indicates a lack of emphasis on sustainability criteria within this preliminary engagement.

No explicit mention of green procurement.
No explicit mention of social aspects.

Strengths

Clear description of the DPC Programme Advisory Framework and required services.
Disclosure of estimated value and contract duration.
Emphasis on fairness in market engagement participation.
Well-defined technical advisory areas.

Concerns

Lack of content in available tender documents.
Absence of specified evaluation criteria for market engagement.
No explicit sustainability considerations mentioned.
No e-submission method specified.

Recommendations

1. Provide content for the tender documents or a clear path to access them.
2. Specify the criteria for evaluating expressions of interest in the market engagement.
3. Incorporate or indicate potential sustainability aspects for future consideration.
