Original Tender Description

Supply of Class 66 Traction Motors - UTEX/Service Exchange Model DRS does not consider itself bound by the Procurement Act 2023 (PA23) and associated procurement legislation (together the “UK procurement legislation”) on the basis that, operating commercially, it is not a public authority, nor does it carry out any utility activities. Accordingly, this Procurement is not, and does not purport to be, subject to UK procurement legislation. For the avoidance of doubt, Tenderers are put on notice that the publication of this document and any other document that relates to this Procurement (including the relevant tender notice) is published voluntarily and nothing in this document, or any other document that DRS publishes in relation to this Procurement, should be construed as purporting to give rise to rights or obligations under UK procurement legislation. That said, DRS intends to operate a fair process which broadly aligns with certain key aspects of the competitive flexible procedure under the PA23 and which aligns with the objectives of section 12(1)-(3) of the PA23.

Tender Quality Score

This tender for Class 66 Traction Motors presents a mixed quality, with strengths in basic information and data consistency, but concerns regarding legal compliance, clarity of evaluation, and sustainability.

Score Breakdown

Legal Compliance60/100

The organization explicitly states it is not bound by UK procurement legislation, which significantly impacts legal compliance. While it aims for a fair process aligned with certain aspects of the PA23, the voluntary nature of the publication and the disclaimer regarding rights and obligations create uncertainty. The CPV code is present, and there are no reported disputes. However, the lack of explicit adherence to procurement law is a notable weakness.

Explicit disclaimer of UK procurement legislation adherence
Voluntary publication and disclaimer of rights/obligations
Clarity70/100

The description of the supply is clear, and the CPV code is provided. However, a significant issue is the absence of specified evaluation criteria, making it unclear how tenders will be assessed. The 'AI-extracted requirements' are largely boilerplate due to the legal disclaimer, offering little specific guidance.

Missing evaluation criteria
Boilerplate requirements due to legal disclaimer
Completeness65/100

Most basic information is present, including title, reference, organization, estimated value, and contract duration. The submission deadline and contract start date are also specified. However, the lack of content in the tender documents is a significant gap, hindering a full assessment of completeness.

No content available for tender documents
Fairness70/100

The estimated value is disclosed, and the procedure is open. The organization states an intention to operate a fair process. However, the lack of specified evaluation criteria and the ambiguity surrounding legal compliance could be perceived as less fair. The absence of information on e-submission also detracts from a fully transparent and accessible process.

Missing evaluation criteria
Ambiguity regarding legal compliance and process fairness
Practicality60/100

Key practical information like contract duration, start date, and estimated value is provided. However, the absence of information regarding e-submission and the lack of content in the tender documents reduce practicality for potential bidders. The URL for documents is not explicitly provided in the snippet.

No e-submission specified
No document content available
Data Consistency90/100

Key fields such as title, reference, organization, value, and dates are populated logically. There are no reported disputes or suspensions. The dates provided for the submission deadline and contract start are consistent with the overall timeline.

Sustainability30/100

There is no mention of green procurement, social aspects, innovation, or EU funding. This indicates a complete lack of focus on sustainability criteria within the tender.
