Original Tender Description

Wirral Council has set up a Dynamic Purchasing System (DPS) for the provision of Passenger Transport Services. The Council is inviting suitably qualified operators to request to participate in the DPS for the provision of its Transport Services covering Private Hire, Hackney Carriage, PSV/PCV and other appropriately licenced vehicles. If you are successfully appointed to the DPS following your submission you will be invited by the Council to submit tenders for relevant services through a call for competition. This DPS remains open for any supplier to request to participate throughout the duration of the DPS. The Council proposes to enter into contracts for periods of up to 3 years, dependent on the requirement, with options to extend. Such extensions will be at the discretion of the Council and subject to satisfactory performance. A combination of Lots/routes may be tendered. We reserve the right to extend, shorten or terminate, in part or whole, any Lot or the entire DPS at any time giving 6 months' notice. This Dynamic Purchasing System (DPS) was established in 2022, with a start date of 01 September 2022. Due to the lack of viable alternatives provided by the Procurement Act 2023 (PA23) and in line with the transition arrangements, the Council is extending the Passenger Transport DPS period of validity - in accordance with Regulation 28(1)(a) of the Public Contracts Regulations 2015 - from 01 September 2026 to 23 February 2029, to ensure continuity of service. All other terms and conditions of the DPS remain unchanged. This Dynamic Purchasing System has a total estimated value of £61 million, (the estimated value of the extension is up to £40 million) covering the period from its establishment in 2022 to the end of its period of validity.

Tender Quality Score

This tender outlines the extension of an existing Dynamic Purchasing System for passenger transport services, providing a clear framework for suppliers to join. While the DPS structure promotes continuous access, the documentation lacks explicit mandatory exclusion grounds, financial requirements, and crucial evaluation criteria for subsequent call-off contracts.

Score Breakdown

Legal Compliance75/100

The tender explicitly references relevant UK procurement regulations (Public Contracts Regulations 2015 and Procurement Act 2023 transition arrangements), indicating an intent for compliance. However, the absence of explicit mandatory exclusion grounds and financial requirements, as noted in the AI summary, represents a notable gap in standard legal disclosures.

Missing explicit mandatory exclusion grounds
Missing explicit financial requirements
Clarity70/100

The description of the Dynamic Purchasing System (DPS) and its extension is clear and unambiguous, as are the eligibility and technical requirements for joining. However, the critical absence of specified evaluation criteria for subsequent calls for competition within the DPS significantly reduces overall clarity regarding the full procurement process.

No evaluation criteria specified for subsequent calls for competition
Completeness70/100

Basic information, deadlines, estimated value, and duration are adequately provided. However, the tender is incomplete due to the lack of explicit mandatory exclusion grounds, financial requirements, and, most notably, the absence of evaluation criteria for future call-off contracts.

Missing explicit mandatory exclusion grounds
Missing explicit financial requirements
Fairness85/100

The DPS structure, allowing continuous supplier participation until 2029, inherently promotes fairness and broad access. The eligibility and technical requirements for joining the DPS are generic and do not appear tailored. However, the lack of specified evaluation criteria for subsequent tenders could raise concerns about transparency and objectivity in the later stages of the procurement process.

No evaluation criteria specified for subsequent calls for competition
Practicality65/100

The tender lists 'E-Procurement' as a characteristic, which suggests modern, practical access. However, the automated check flags 'No e-submission', creating a contradiction that needs clarification. The absence of explicit document URLs is a minor practical drawback.

Contradiction regarding e-submission support
No explicit document URLs provided
Data Consistency90/100

The tender generally exhibits good data consistency with logical dates and populated key fields. Minor inconsistencies include empty codes for the procedure type, a missing 'Liable Person', and a currency discrepancy between the stated estimated value (EUR) and the description (£).

Empty codes for procedure type
Missing 'Liable Person'
Sustainability50/100

The tender does not explicitly integrate green procurement, social criteria (beyond the service requirement for vulnerable individuals), or innovation focus into its requirements or evaluation. This indicates a missed opportunity to leverage procurement for broader sustainability goals.

No explicit green procurement criteria
No explicit social criteria (as procurement criteria)

Strengths

Clear description of the Dynamic Purchasing System (DPS) and its extension.
Open-ended participation for suppliers throughout the DPS duration.
Generic and non-tailored eligibility and technical requirements for joining the DPS.
Value and duration of the DPS are clearly specified.
E-Procurement characteristic indicates modern access.

Concerns

Absence of explicit mandatory exclusion grounds and financial requirements.
Lack of specified evaluation criteria for subsequent calls for competition within the DPS.
Contradiction regarding e-submission (E-Procurement characteristic vs. 'No e-submission' flag).
No explicit integration of green, social, or innovation procurement criteria.
Minor data inconsistencies (e.g., currency, empty codes).

Recommendations

1. Clearly define mandatory exclusion grounds and financial requirements for DPS participation.
2. Provide at least general principles or a framework for evaluation criteria applicable to subsequent call-off contracts.
3. Clarify the e-submission process to resolve the contradiction and ensure full electronic functionality.
