Original Tender Description

The Teaching Regulation Agency (TRA) intends to procure mulitple external legal services to support the investigation, preparation and presentation of teacher misconduct cases, building on the model used under current Presenting Officer (PO) contracts. These services include undertaking proportionate investigations, preparing case documentation for Case to Answer decisions and Professional Conduct Panel (PCP) hearings, and presenting cases at hearings on behalf of the TRA. The TRA will conduct early market engagement to present our high level approach to the future service model and ensure suppliers have clarity ahead of formal procurement. These sessions will allow us to explore practical considerations, understand market capacity and incorporate sector insight into refining the delivery model. After the event, suppliers will be invited to complete a questionnaire to provide feedback that will support the TRA’s development of its service model. This procurement will therefore establish a resilient, flexible legal services arrangement capable of meeting both current statutory obligations and the wider future scope of the Teacher Misconduct regime. *Please be aware that registration is for the Market Engagement Event only. This event does not signify the commencement of any procurement process and does not constitute any commitment by the Department for Education. This is NOT an invitation to tender for a contract opportunity and any suppliers invited to the event will not have a privileged position in relation to any future contract opportunity. Any subsequent procurement(s) that DfE conducts will be based on the fair and objective outcome of a procurement process.* The DfE is keen to maximise opportunities to participate in procurement for Small to Medium-sized Enterprises (SMEs) and Voluntary, Community and Social Enterprises (VCSEs). Consideration will also be given to consortia and collaborative bids from all forms of organisations.

Tender Quality Score

This is a pre-tender market engagement notice for legal services to support teacher misconduct cases. While clarity on the scope of services and financial value is good, the notice is not a formal tender, lacking detailed evaluation criteria and e-submission specifics. It demonstrates an intention to engage SMEs/VCSEs.

Score Breakdown

Legal Compliance75/100

The notice is in the 'planning' status and is explicitly a market engagement event, not a formal tender. This means traditional legal compliance checks for a tender (like clear procedure, regulatory compliance for submission) are not fully applicable yet. The deadline of 2026-04-23 for market engagement registration is reasonable for its purpose. CPV code is provided.

Clarity80/100

The description of the required services (investigation, preparation, presentation of teacher misconduct cases) is clear. The objective of the market engagement to refine the service model is well-communicated. Explicitly states this is not a tender invitation, managing expectations.

Completeness70/100

Basic information like title, organization, estimated value, contract duration, and start date are present. However, as this is a market engagement notice, details expected in a full tender (like specific submission documents, detailed evaluation criteria, exclusion grounds) are naturally absent.

Missing explicit details on tender documents that will be provided in the future.
Fairness85/100

The notice emphasizes a fair and objective procurement process in the future and explicitly states that attendance at the market engagement event confers no privileged position. It also expresses a strong commitment to maximizing opportunities for SMEs and VCSEs, and encourages consortia bids, indicating a fair approach to market entry.

Practicality65/100

As this is a market engagement event, practicality for tender submission (e-submission, document URL) is not applicable at this stage. The contract start date and duration are provided, offering some foresight for potential bidders. Financing information is implied through the estimated value.

No direct URL for market engagement registration provided, likely communicated through separate channels.
Data Consistency90/100

Key fields such as title, organization, estimated value, contract duration, and start date are consistently populated. The dates are logical, with the contract start date well after the current date and the submission deadline. No disputes or suspensions are indicated.

Sustainability50/100

The notice does not explicitly mention green procurement, social aspects, innovation, or EU funding. While it encourages SMEs/VCSEs and consortia, these are more related to market participation than specific sustainability criteria within the service delivery itself.

No mention of green procurement criteria.
No mention of social value or innovation requirements.

Strengths

Clear intent for market engagement to shape future procurement.
Explicit commitment to fairness and SME/VCSE participation.
Well-defined scope of required legal services.
Transparent communication about the nature of the notice (market engagement vs. tender).

Concerns

Absence of tender-specific details (evaluation criteria, submission process) as it's a pre-tender notice.
Lack of explicit sustainability or innovation focus mentioned.

Recommendations

1. Ensure future tender documents clearly outline evaluation criteria and submission processes.
2. Consider incorporating sustainability and innovation objectives into the future tender requirements.
