Original Tender Description

Norfolk Environmental Credits Limited ('NEC') intends to establish an open framework agreement for the supply of nutrient mitigation solutions from catchments in Norfolk. It is anticipated that the Framework Agreement will enable participating suppliers to enter into flexible arrangements to address market demand for nutrient neutrality mitigation. Under the Framework Agreement, suppliers will be called upon via further competition or direct award to provide a legally secured nutrient mitigation via a section 106 Agreement with the local planning authority. The nutrient mitigation will be sought from low grade arable land located within designated nutrient neutrality catchments in Norfolk. Contracts under the Open Framework will be for both temporary (up to 5 years) or permanent (90-100 years) nutrient mitigation. Mitigation outcomes will be quantified using a consistent and approved methodology. Nutrient reductions will be achieved by converting high input agricultural land (such as arable cereal production) to lower nutrient land uses, including greenspace or low intensity grazing. Through the Framework Agreement, NEC aims to procure nutrient mitigation (covering both Phosphorus and Nitrogen) measured in kg/year from qualified suppliers. Please note that the estimated total value set out in this Planned Procurement Notice relates to the Open Framework Scheme but otherwise this Notice relates to the anticipated competition and award of the first framework agreement under the Open Framework Scheme.

Tender Quality Score

This tender, a 'Planned Procurement Notice', outlines a clear environmental objective but suffers from significant gaps in documentation, evaluation criteria, and financial requirements, impacting its completeness and fairness. While the technical scope is well-defined, the lack of accessible tender documents and specified evaluation methods presents considerable challenges for potential bidders.

Score Breakdown

Legal Compliance75/100

The tender clearly defines the 'Open procedure' and assigns a relevant CPV code. There are no reported disputes or suspensions. However, the absence of detailed mandatory exclusion grounds and the lack of accessible full tender documents make it difficult to fully verify compliance with national procurement regulations. The 'planning' status suggests more details are forthcoming.

No detailed mandatory exclusion grounds provided in the summary.
Full tender documents are not accessible for review.
Clarity70/100

The description of the nutrient mitigation solutions, scope, and technical requirements is exceptionally clear and unambiguous. However, the complete absence of evaluation criteria and specific financial requirements (beyond the estimated value) significantly reduces the overall clarity of the procurement process for potential suppliers.

No evaluation criteria specified.
No specific financial requirements detailed beyond the estimated value.
Completeness60/100

Basic information such as title, organization, value, duration, and deadlines are present. However, the critical absence of actual tender documents, detailed financial requirements, and comprehensive evaluation criteria represents a significant gap. The 'planning' status mitigates this slightly, but for a 'Planned Procurement Notice', more information or a clear path to it would be expected.

No actual tender documents are accessible or summarized.
Missing detailed financial requirements.
Fairness55/100

The lack of accessible tender documents and the complete absence of specified evaluation criteria are major concerns for fairness and transparency. Without these, bidders cannot adequately prepare or understand the basis of award. The absence of e-submission also limits equal access for all potential suppliers.

No full document access for potential bidders.
No evaluation criteria specified, impacting transparency.
Practicality60/100

While key dates like contract start and duration are provided, the practicality for bidders is severely hampered by the lack of accessible tender documents and the absence of electronic submission. This creates significant barriers to participation and efficient engagement with the procurement process.

No accessible tender documents.
No electronic submission (e-submission) supported.
Data Consistency90/100

The provided data is largely consistent and logical. Key fields are populated, and dates are coherent. The 'planning' status helps explain minor omissions in detail, maintaining overall data integrity.

Sustainability70/100

The tender's core objective is inherently sustainable, focusing on 'nutrient mitigation solutions' and 'environmental credits'. This represents a strong commitment to green procurement. However, there is no explicit mention of social aspects or innovation focus, which are often integrated into comprehensive sustainability frameworks.

No explicit social criteria mentioned.
No explicit innovation focus mentioned.

Strengths

Clear and detailed description of the environmental objective and technical scope.
Relevant CPV code and clear procedure type.
Value, duration, and key dates are specified.
Strong inherent focus on environmental sustainability.

Concerns

Critical lack of accessible tender documents.
Absence of specified evaluation criteria.
Missing detailed financial requirements and mandatory exclusion grounds.
No electronic submission capability.

Recommendations

1. Publish full tender documents immediately to ensure transparency and allow adequate preparation time for bidders.
2. Clearly define and publish all evaluation criteria and financial requirements.
3. Implement an e-submission platform to enhance accessibility and efficiency for all potential suppliers.
