Original Tender Description

Supply of Class 66 Traction Motors - UTEX/Service Exchange Model DRS does not consider itself bound by the Procurement Act 2023 (PA23) and associated procurement legislation (together the “UK procurement legislation”) on the basis that, operating commercially, it is not a public authority, nor does it carry out any utility activities. Accordingly, this Procurement is not, and does not purport to be, subject to UK procurement legislation. For the avoidance of doubt, Tenderers are put on notice that the publication of this document and any other document that relates to this Procurement (including the relevant tender notice) is published voluntarily and nothing in this document, or any other document that DRS publishes in relation to this Procurement, should be construed as purporting to give rise to rights or obligations under UK procurement legislation. That said, DRS intends to operate a fair process which broadly aligns with certain key aspects of the competitive flexible procedure under the PA23 and which aligns with the objectives of section 12(1)-(3) of the PA23.

Tender Quality Score

This tender for Class 66 Traction Motors presents a moderately clear and complete set of requirements, but suffers from a lack of explicit legal compliance and sustainability considerations, alongside practical submission challenges.

Score Breakdown

Legal Compliance60/100

The organization explicitly states it is not bound by UK procurement legislation, which significantly impacts legal compliance scoring. While it aims for a fair process aligned with certain aspects of PA23, the voluntary nature of the publication and lack of formal legal obligation create uncertainty. The CPV code is present, and there are no reported disputes, but the absence of a clear legal framework is a notable weakness.

Explicitly not bound by UK procurement legislation.
Voluntary publication of tender documents.
Clarity70/100

The description of the required goods (Class 66 Traction Motors - UTEX/Service Exchange Model) is clear. Mandatory exclusion grounds, eligibility, technical, and financial requirements are outlined. However, the absence of specified evaluation criteria leaves potential bidders uncertain about how their submissions will be assessed.

Missing evaluation criteria.
Completeness65/100

Basic information such as title, reference, organization, estimated value, and contract duration are provided. The contract start date is also specified. However, the crucial 'reveal date' is missing, and the tender documents themselves are not available for review, hindering a full assessment of completeness.

Missing reveal date.
No tender document content available.
Fairness75/100

The estimated value is disclosed, and the process aims to be fair, broadly aligning with certain aspects of competitive procedures. The deadlines appear reasonable given the context. However, the lack of explicit evaluation criteria could be perceived as less objective. The absence of information on e-submission also raises questions about accessibility.

No e-submission specified.
Missing evaluation criteria.
Practicality55/100

The submission deadline is provided, and the contract start date is clear. Financing information is not explicitly detailed, and the lack of e-submission is a significant practical hurdle. The requirement for bids in multiple languages (English, Estonian, Latvian, Polish, and Lithuanian) adds complexity for bidders.

No e-submission specified.
Bids required in multiple languages.
Data Consistency85/100

Key fields such as title, reference, organization, value, and dates are populated. There are no reported disputes or suspensions. The dates provided (submission deadline, contract start) are logically sequenced. The CPV code is present and relevant.

Sustainability30/100

There is no mention of green procurement, social aspects, or innovation within the tender. The tender is not indicated as EU funded. This lack of focus on sustainability aspects significantly lowers the score in this category.

No green procurement considerations.
No social criteria mentioned.

Strengths

Clear title and reference number.
Organization and description provided.
Estimated value and contract duration specified.
CPV code included.

Concerns

Explicit exclusion from UK procurement legislation.
Missing evaluation criteria.
Lack of e-submission.
No sustainability considerations.

Recommendations

1. Clarify evaluation criteria to ensure transparency.
2. Implement an e-submission process for improved accessibility.
3. Incorporate sustainability objectives into the tender.
