Original Tender Description

The Baglan Bay site, in the South Wales area was previously operated as a chemical works and was acquired in 2022. The aspiration for the development of the site is to transform the area through the creation of high-quality jobs, creating a safe and higher quality environment for local people, and to contribute to the wider redevelopment of the region. However, due to previous usage of the site, remediation will be required to safely bring the site back into the wider public sphere. The Welsh Government is providing potential market participants with early notice of the forthcoming Baglan Contamination Remediation Procurement. This notices, and supporting document provides preliminary details in respect of the background, objectives and intended delivery approach for the Project , to enable interested organisations to consider and prepare for the formal tender process, which is expected to commence in Q3/Q4 2026. The information contained is provided for the purpose of awareness only. It does not constitute a call for competition, nor does it commit the Welsh Government to proceed with any procurement. The Welsh Government intends to launch the Project procurement through the Competitive Flexible Procedure under the Procurement Act 2023. The Contractor will be responsible for design, testing, implementation of remediation techniques, monitoring and validation. To ensure fairness to the market, Welsh Government will offer two opportunities to share information with companies about the remediation works. There will be an optional Site Visit and an optional Online presentation for companies to attend. Welsh Government is committed to sharing all essential information with all bidders and will keep written records of who participated, what was discussed, information that was shared and how risks of distortion were mitigated. This is to ensure no unfair advantage is gained through participating in the market engagement.

Tender Quality Score

This is an early market engagement notice for a significant remediation project. While it provides a good overview and outlines the intended procurement procedure, it lacks specific details on evaluation criteria and mandatory requirements, impacting completeness and clarity for potential bidders.

Score Breakdown

Legal Compliance75/100

The notice indicates a forthcoming procurement under the Procurement Act 2023, suggesting adherence to current UK legislation. The mention of a 'Competitive Flexible Procedure' implies a structured process. However, the absence of specific deadlines for the formal tender and the current 'planning' status mean that full regulatory compliance cannot be fully assessed at this stage. The CPV code is appropriate for the described works.

Formal tender deadline not yet specified.
Clarity80/100

The description of the project's background, objectives, and the intended scope of work (design, testing, implementation, monitoring, validation) is reasonably clear. The commitment to transparency in market engagement is also well-articulated. However, the lack of specific evaluation criteria and detailed eligibility requirements leaves some ambiguity for potential participants.

No evaluation criteria specified.
Eligibility requirements are broadly stated.
Completeness70/100

Key information such as the estimated value, contract duration, and contract start date are provided. The organization and CPV code are also present. However, the absence of the formal tender submission deadline and the lack of content in the tender documents (as indicated by 'Documents with content/summaries: 0') limit the completeness of the information available at this early stage.

Formal tender submission deadline is missing.
No content available for attached tender documents.
Fairness85/100

The Welsh Government's commitment to offering optional site visits and online presentations, along with detailed record-keeping of market engagement, demonstrates a strong effort to ensure fairness and mitigate information distortion. The disclosure of the estimated value and the intention to use a standard procurement procedure also contribute to fairness. The process is designed to allow early market consideration without committing to a specific company.

Practicality65/100

The notice is for early awareness and indicates the formal tender is expected in Q3/Q4 2026, with a submission deadline of 2026-06-30 provided, which appears to be for an earlier stage or market engagement rather than the final tender. The lack of information on e-submission methods for the formal tender and the absence of explicit financing details reduce practicality at this stage. The contract duration and start date are specified.

E-submission method for formal tender not specified.
Financing information not explicitly detailed.
Data Consistency90/100

The provided data is generally consistent. Key fields like title, reference, organization, estimated value, and contract duration are populated. The dates provided, while indicating an early stage, do not present immediate logical contradictions within the context of a planning notice. There are no indications of suspension or disputes.

Sustainability50/100

The description mentions aspirations for creating high-quality jobs and a safer environment, which touch upon social aspects. However, there is no explicit mention of green procurement criteria, innovation requirements, or confirmation of EU funding, which are common elements in sustainability considerations for public tenders.

No explicit green procurement criteria mentioned.
No explicit innovation focus mentioned.

Strengths

Clear project background and objectives.
Commitment to fair market engagement.
Disclosure of estimated value and contract duration.
Identification of intended procurement procedure.

Concerns

Missing formal tender submission deadline.
Lack of specified evaluation criteria.
No content available for tender documents.
Ambiguity regarding e-submission for the formal tender.

Recommendations

1. Provide specific evaluation criteria for the formal tender.
2. Clarify the e-submission process for the formal tender.
3. Ensure all relevant tender documents are made available with detailed content.
