Original Tender Description

The Teaching Regulation Agency (TRA) intends to procure mulitple external legal services to support the investigation, preparation and presentation of teacher misconduct cases, building on the model used under current Presenting Officer (PO) contracts. These services include undertaking proportionate investigations, preparing case documentation for Case to Answer decisions and Professional Conduct Panel (PCP) hearings, and presenting cases at hearings on behalf of the TRA. The TRA will conduct early market engagement to present our high level approach to the future service model and ensure suppliers have clarity ahead of formal procurement. These sessions will allow us to explore practical considerations, understand market capacity and incorporate sector insight into refining the delivery model. After the event, suppliers will be invited to complete a questionnaire to provide feedback that will support the TRA’s development of its service model. This procurement will therefore establish a resilient, flexible legal services arrangement capable of meeting both current statutory obligations and the wider future scope of the Teacher Misconduct regime. *Please be aware that registration is for the Market Engagement Event only. This event does not signify the commencement of any procurement process and does not constitute any commitment by the Department for Education. This is NOT an invitation to tender for a contract opportunity and any suppliers invited to the event will not have a privileged position in relation to any future contract opportunity. Any subsequent procurement(s) that DfE conducts will be based on the fair and objective outcome of a procurement process.* The DfE is keen to maximise opportunities to participate in procurement for Small to Medium-sized Enterprises (SMEs) and Voluntary, Community and Social Enterprises (VCSEs). Consideration will also be given to consortia and collaborative bids from all forms of organisations.

Tender Quality Score

This is a planning notice for a market engagement event rather than a formal tender. While the information provided is clear and generally well-structured, it lacks crucial details regarding the formal procurement process, evaluation criteria, and specific sustainability considerations.

Score Breakdown

Legal Compliance75/100

The notice is in a 'planning' status, indicating it's pre-procurement. The CPV code is appropriate for legal services. Deadlines are mentioned but the submission deadline seems distant given the planning status. There is no indication of disputes or regulatory non-compliance. The lack of a formal tender structure limits a full assessment of legal compliance at this stage.

Clarity80/100

The description of the required services is clear and detailed, outlining the scope of work for presenting officer services. Eligibility and technical capability requirements are well-articulated. The purpose of the market engagement event is also clearly stated. However, evaluation criteria for the future procurement are missing.

Missing evaluation criteria for the future procurement.
Completeness70/100

Basic information such as title, organization, and estimated value is present. Contract duration and start date are specified. However, crucial tender documents with content are missing, and the formal procurement details (e.g., evaluation criteria) are not yet available as this is a market engagement notice.

No tender documents with content available.
Formal procurement details are absent.
Fairness85/100

The tender appears fair by disclosing the estimated value and indicating a commitment to maximizing opportunities for SMEs and VCSEs. Encouraging consortia and collaborative bids promotes wider participation. The market engagement phase aims to provide clarity ahead of formal procurement. The text explicitly states that the market engagement event does not give any privileged position to suppliers.

Practicality65/100

The notice indicates a planned contract start date and duration. However, it is a market engagement notice, not an invitation to tender, so e-submission details for a tender are not applicable. Financing information is not provided. The lack of explicit e-submission instructions for the formal tender stage is a drawback for practical execution.

No e-submission details for the formal tender.
Data Consistency90/100

Key fields such as title, organization, estimated value, CPV, and dates are populated. There are no reported disputes. The dates provided (submission deadline and contract start) are logical in sequence. The status being 'planning' aligns with the market engagement nature of the notice.

Sustainability30/100

The notice makes no mention of green procurement, social aspects, or innovation. While it encourages participation from VCSEs, this is more about accessibility than specific social procurement goals. The absence of any sustainability criteria or focus is a significant gap.

No mention of green procurement, social aspects, or innovation.

Strengths

Clear description of services required.
Commitment to SME/VCSE participation.
Disclosure of estimated value.
Market engagement planned for clarity.

Concerns

No formal tender details provided (evaluation criteria, submission process).
Absence of sustainability criteria.
Lack of specific documents for review.
Implied distant submission deadline for a planning phase.

Recommendations

1. Clearly outline the evaluation criteria for the future procurement.
2. Incorporate sustainability objectives into the procurement strategy.
3. Provide access to draft tender documents during or after market engagement.
