Original Tender Description

Framework Agreement for the Supply of Unlicensed Specials to members of the East Midlands Pharmacy Collaborative (EMPC). Unlicensed specials are purchased to meet the clinical needs of patients for which no suitable licensed medicine is available. Supplier(s) should be flexible to meet varying levels of demand and to respond to clinical change and development. Participating Authorities within the East Midlands lack the capacity to manufacture sufficient unlicensed specials to meet their needs. Therefore, we are seeking supplier/s who are able to offer a high-quality, cost-effective service. Purchasing Authorities will buy these products to hold as stock, to meet the anticipated future needs of their patients. These unlicensed specials will be required to be batch produced and quality assured. It is EMPC's intention to contract directly with the Manufacturer’s “Specials” Licence holder. Pre-Market Engagement meetings were held on 11th, 20th and 24th November 2025. Notes of the PME meetings are included in the Tender document set Above threshold with electronic submission and full tender documents provided when the notice has been published. The minimum tender period of 25 days has been included.

Tender Quality Score

This tender for unlicensed pharmaceutical products is generally well-structured, with clear objectives and reasonable eligibility criteria. However, it lacks explicit evaluation criteria and details on sustainability initiatives, which could be improved.

Score Breakdown

Legal Compliance75/100

The tender appears to be compliant with standard open procedure rules, including the use of a relevant CPV code and disclosure of estimated value. The mention of a minimum tender period of 25 days suggests adherence to some regulatory timeframes, although the overall deadline length is not explicitly assessed as reasonable or unreasonable without further context. The absence of reported disputes or suspensions is a positive indicator.

Clarity80/100

The description of the framework agreement is clear, outlining the need for unlicensed specials to meet patient clinical needs. The requirements for suppliers, such as flexibility and quality assurance, are well-articulated. The AI-extracted requirements also provide a good overview of expectations.

Completeness70/100

Most basic information is present, including title, reference, organization, estimated value, contract duration, and start date. However, the 'Documents with content/summaries: 0' flag indicates that the actual tender documents, which would contain critical details like evaluation criteria and detailed specifications, are not accessible for analysis, impacting the perceived completeness.

No document content available for detailed analysis.
Fairness85/100

The tender specifies an open procedure, discloses the estimated value, and mentions electronic submission, promoting fairness. The requirement for suppliers to be 'Specials' Licence holders is a necessary qualification, not an unfair tailoring. The inclusion of pre-market engagement meetings is a positive step towards transparency. The absence of specific tailored requirements for individual companies is noted.

Practicality65/100

The tender mentions 'electronic submission' which is positive for practicality. However, the 'Checks' section flags 'No e-submission,' which creates a contradiction. The lack of explicit financing information and potential issues with the contract start date relative to the submission deadline (though not explicitly flagged as an issue here) could be improved.

Contradictory information regarding e-submission.
Data Consistency90/100

Key fields such as title, reference, organization, value, and deadlines are populated. The status is 'active', and there are no reported disputes or suspensions. Dates appear logically sequenced, with the contract start date following the submission deadline. The CPV code and NUTS code are also provided.

Sustainability40/100

The tender lacks explicit mentions of green procurement, social aspects, or innovation. It is also not indicated as EU funded. This suggests a moderate to low focus on sustainability criteria within this procurement process.

No explicit green procurement criteria.
No explicit social criteria.

Strengths

Clear description of needs and supplier expectations.
Open procedure and disclosed estimated value.
Inclusion of pre-market engagement meetings for transparency.
Relevant CPV code and NUTS code provided.

Concerns

Lack of accessible full tender documents for comprehensive review.
Missing explicit evaluation criteria.
Contradictory information on e-submission.
Limited explicit focus on sustainability aspects.

Recommendations

1. Ensure full tender documents are readily available and contain detailed evaluation criteria.
2. Clarify and confirm the e-submission process.
3. Integrate and clearly state any sustainability, social, or innovation requirements.
