Original Tender Description

The Council is seeking to appoint service providers to the Employability Procured Service Arrangement (PSA). This is a bespoke arrangement/flexible framework which has been developed primarily for Employability Services but can be accessed by all services within the Council. The PSA will be procured using the “light touch” procedure set out in Regulations 74 -76 of the Public Contracts (Scotland) Regulations 2015 (“the 2015 Regulations”). This allows the Council to carry out a selection process which adopts the principles of equal treatment, non-discrimination and transparency and complies with procurement best practice without requiring the use of the traditional open or restricted procedure set out in the 2015 Regulations. The PSA has a broad scope of service delivery with the opportunity for many providers to be appointed. There is no limit on the number of providers who can be appointed to any of the lots under the PSA. The PSA remains open for its lifetime which allows for new providers to be added over its term, at regular intervals which will be advised by the Council. Applicants to the PSA will be evaluated in ‘Phases’, based on the closing date for each Phase. Following the closing of each Phase, the PSA will re-open for new applications for the next Phase.

Tender Quality Score

This tender establishes a flexible framework for employability services, allowing for continuous applications. While generally fair and well-structured, key information regarding evaluation criteria and specific technical/financial requirements is missing.

Score Breakdown

Legal Compliance75/100

The tender adheres to the 'light touch' procedure, aligning with Scottish regulations (2015 Regulations) and emphasizing equal treatment, non-discrimination, and transparency. The CPV code is appropriate. However, the absence of a specified reveal date and potential issues with deadline length are noted.

Missing reveal date
Potential for short deadline
Clarity70/100

The description of the Employability Procured Service Arrangement (PSA) as a bespoke, flexible framework is clear. The phased application process and the open nature of the PSA are well-articulated. However, the lack of specific technical capability and financial requirements introduces ambiguity.

No specific technical capability requirements detailed
No specific financial requirements detailed
Completeness65/100

Basic information such as title, reference, organization, value, and deadline are present. The description outlines the nature of the PSA. However, crucial details like evaluation criteria, contract duration, and the specific content of tender documents are missing, impacting overall completeness.

Missing evaluation criteria
No document content available
Fairness85/100

The 'light touch' procedure, phased application system, and unlimited provider appointments promote fairness. E-procurement is indicated, and the principles of equal treatment, non-discrimination, and transparency are stated. The broad scope and open nature of the PSA suggest a high degree of fairness for potential bidders.

Practicality60/100

The tender mentions e-procurement. However, the 'Issues' list flags 'No e-submission,' which is contradictory. Missing information on contract start date and financing also reduces practicality. The phased approach, while flexible, may require ongoing monitoring by potential providers.

No e-submission (contradictory flag)
Missing contract start date
Data Consistency90/100

Key fields like title, reference, organization, value, and deadline are populated. There are no reported disputes or suspensions. The dates provided are logical within the context of a live tender. The phased approach, while noted, does not inherently create inconsistencies in the provided basic data.
