Original Tender Description

Nottinghamshire County Council (the ‘Council’) wish to continue to appoint Providers to their Multi Provider ‘Framework Agreement’ to deliver Care, Support and Enablement (CSE) services across Nottinghamshire County. From time to time the Framework Agreement may also be used to commission CSE services outside of Nottinghamshire County boundaries. For background, the Council first issued an invitation to tender (ITT) for this opportunity in November 2022. The objective of the initial procurement exercise was to establish: · A pool of Providers to deliver CSE services within Supported Living settings (lot 1), and; · A pool of Providers to deliver CSE Outreach services (lot 2), as well as; · A number of ‘ranked lists’ split by geographical area under those categories Applications to become a party to lot 1 and/or lot 2 of the Framework Agreement are welcomed on an ongoing basis for the term of the Framework Agreement and will be evaluated on a six monthly basis as described in more detail in the tender documentation. However, the ranked lists (lots 1a-g and 2a-g, tendered as part of the initial procurement exercise) are not currently open for bidding. Any future opportunities to bid for the ranked lists will be the subject of a mini competition which will only be open to suitably qualified Providers under lot 1 or lot 2 of the Framework Agreement. This opportunity is relevant to Providers who are interested in lot 1 and/or lot 2 and who have not previously bid for lot 1 and/or lot 2 or, were unsuccessful in their previous bid(s).

Tender Quality Score

This tender outlines an ongoing multi-provider framework for care services but suffers from critical omissions in documentation, financial requirements, and evaluation criteria, severely impacting transparency and fairness.

Score Breakdown

Legal Compliance100/100

Seriously deficient. The absence of explicitly mentioned mandatory exclusion grounds, specific financial requirements, and detailed tender documents makes it difficult to assess compliance with public procurement regulations. The lack of evaluation criteria is also a significant legal gap.

Absence of explicit mandatory exclusion grounds.
Lack of specific financial requirements (e.g., minimum turnover, insurance levels).
Clarity40/100

While the overall structure of the framework (ongoing applications for Lots 1 & 2, mini-competitions for ranked lists) is described, the lack of detailed tender documents, specific technical requirements, and evaluation criteria makes it impossible for potential bidders to understand what is truly required.

No tender documents available to provide detailed instructions.
Vague technical capability requirements ('Demonstrate the ability').
Completeness66/100

Highly incomplete. Key information such as estimated value, detailed tender documents, specific financial and technical requirements, and evaluation criteria are missing. This makes it impossible for a bidder to prepare a comprehensive and compliant offer.

Estimated value not disclosed.
No tender documents provided.
Fairness60/100

The lack of detailed tender documents, specific requirements, and transparent evaluation criteria creates a significant risk to fairness. Without clear rules, the procurement process can appear arbitrary, potentially disadvantaging bidders who lack prior insight or established relationships. The vagueness of requirements could also allow for tailoring during evaluation.

Absence of detailed tender documents and evaluation criteria creates an uneven playing field.
Vague requirements could lead to subjective evaluation and potential for tailoring.
Practicality20/100

From a bidder's perspective, it is impractical to submit a quality bid without the actual tender documents, detailed requirements, and evaluation criteria. From the contracting authority's perspective, evaluating bids based on such limited information would be challenging and prone to inconsistencies.

Bidders cannot practically prepare a compliant and competitive offer without tender documents.
Evaluation on a six-monthly basis without clear criteria is impractical and risks inconsistency.
Data Consistency100/100

The provided data is internally consistent, but its limited scope makes it difficult to assess consistency with external or implied requirements. The description of the framework's structure is consistent with the eligibility and submission requirements.

Sustainability0/100

No information regarding sustainability criteria, environmental considerations, social value, or ethical sourcing is provided. This represents a missed opportunity to integrate broader public value objectives.

Absence of any sustainability or green procurement requirements.

Strengths

Clear framework structure with ongoing application opportunities for Lots 1 & 2, promoting market access.
Well-defined purpose of the framework agreement.
Regular six-monthly evaluation of applications for flexibility.
Clear distinction between open lots and future mini-competition lots.

Concerns

Critical lack of tender documents, making it impossible to bid effectively.
Absence of estimated value, hindering financial transparency.
Missing mandatory exclusion grounds and specific financial requirements, raising legal and fairness issues.
Vague technical requirements and missing evaluation criteria, impacting clarity and fairness.
No sustainability considerations, representing a missed opportunity for broader public value.

Recommendations

1. Immediately publish comprehensive tender documents, including detailed specifications, financial requirements, and explicit evaluation criteria.
2. Disclose the estimated value of the framework agreement to enhance transparency.
3. Clearly state all mandatory exclusion grounds and minimum financial stability requirements in line with procurement regulations.
