Original Tender Description

Background Greatness Recreation Ground has become more and more popular as a local open space facility. It is developing from an original open space recreation ground into a more formal park. This is likely to only increase with a neighbouring development of approximately 900 dwellings to be started within the next five years. It is also the home of the very successful Sevenoaks Town Football Club, which brings many visitors to the park. During 2026 the football club's new pavilion is due to be completed. Bearing in mind all these changes Sevenoaks Town Council carried out a community survey relating to the future of the open space and its facilities. From the responses it was clear that the current Outdoor Gym Equipment which has been in place for fifteen years needed to be reviewed and upgraded. Following consultation, it was also agreed to move its location to enable users to access without crossing the field. The new location will also be closer to the new pavilion which will have toilets and a café. Key Points 1. The tender is for new outdoor gym equipment installed on safety surface. 2. Minimum of three pieces of equipment. 3. To create a wetpour base under each piece of equipment which compiles with BSEN 1176 and has a minimum guarantee of 2 years but preferably longer. A maintenance plan is a desirable extra service we would like. The product should have been tested in accordance with BS EN 1177 and BS EN 7188. 4. Timetable • May 2026 public consultation on preferred options A1 size image of outdoor gym to be provided. • July 2026 appointment of contractor • October 2026 installation 5. Size of Outdoor Gym Area Existing: Approx 11.5m length x 7.3m width New: Approx 11.5m length x 7.3 width, with scope for reduction depending on scale of proposed equipment 6. Only tenderers with a current API (Association of Play Industries) membership will be considered for the project. 7. A site visit is advised in preparation of your tender to assess access etc. Budget for the Project Maximum budget for the play area project is £20,000.

Tender Quality Score

This tender for outdoor gym equipment has significant deficiencies, particularly regarding fairness, completeness, and clarity, making it challenging for bidders to submit a compliant and competitive offer. The mandatory API membership requirement is unduly restrictive, and critical documents are missing.

Score Breakdown

Legal Compliance55/100

The mandatory requirement for API (Association of Play Industries) membership is highly restrictive and could be seen as limiting competition, potentially violating procurement principles even for below-threshold tenders. Furthermore, the tender lacks explicit mandatory exclusion grounds and specified evaluation criteria, which are fundamental for legal transparency.

Mandatory API membership requirement is unduly restrictive.
No explicit mandatory exclusion grounds stated.
Clarity45/100

While the technical requirements for the equipment and safety surfacing are generally clear, the complete absence of evaluation criteria is a major deficiency. Tenderers lack crucial information on how their proposals will be assessed, making it impossible to effectively tailor their bids beyond basic compliance.

No evaluation criteria specified.
Completeness35/100

The tender is critically incomplete due to the 'Page not found' error for 'Attachment A-10759: Submission Forms'. Without these forms, tenderers cannot properly prepare and submit their bids. The absence of evaluation criteria also contributes to the incompleteness of the tender documentation.

Critical 'Submission Forms' document is unavailable.
No evaluation criteria specified.
Fairness25/100

Fairness is severely compromised by several factors: the mandatory API membership requirement significantly restricts competition, potentially tailoring the tender to a specific group of companies. The unavailability of submission forms and the complete absence of evaluation criteria prevent equal and transparent access and assessment. The lack of e-submission further limits accessibility.

Mandatory API membership requirement is highly restrictive.
Critical 'Submission Forms' document is unavailable.
Practicality40/100

The tender's practicality is low due to the lack of electronic submission support, which is a standard expectation in modern procurement. More critically, the 'Page not found' error for the submission forms renders the practical act of tendering impossible for potential bidders.

No electronic submission supported.
Critical 'Submission Forms' document is unavailable.
Data Consistency50/100

There are notable inconsistencies in the tender information. The estimated value is stated as 24,000.00 EUR, while the budget in the description is £20,000, creating a currency and value discrepancy. Furthermore, the project timeline is confusing, with the contract start date (June 30) preceding the contractor appointment (July) and the installation (October), which is illogical for a 2-month contract duration.

Inconsistency between estimated value (EUR) and budget (GBP).
Inconsistent project timeline (contract start vs. appointment/installation).
Sustainability20/100

The tender does not include any explicit requirements or considerations related to green procurement, social aspects, or innovation. This is common for smaller, local tenders but results in a low score for sustainability.

No green procurement criteria.
No social aspects mentioned.

Strengths

Clear project description and background information.
Specific technical requirements for equipment and safety surfacing are well-defined.
Value disclosed and CPV code provided.
Reasonable submission deadline (32 days from today's date).

Concerns

Mandatory API membership requirement is highly restrictive and potentially anti-competitive.
Critical 'Submission Forms' document is unavailable, preventing proper tender submission.
No evaluation criteria specified, leading to a lack of transparency and fairness.
Inconsistencies in financial figures (EUR vs. GBP) and project timeline.
Lack of electronic submission functionality.

Recommendations

1. Remove or provide a robust justification for the mandatory API membership requirement to ensure broader competition.
2. Immediately rectify the issue with the 'Submission Forms' document to ensure all necessary tender documents are accessible.
3. Clearly define and publish the evaluation criteria to ensure transparency and fairness in the assessment process.
