Fair

Tender Quality Score

This tender presents significant transparency and fairness concerns due to confidential core documents and high qualification requirements, despite clear evaluation criteria. The process introduces barriers for potential bidders before full tender details are accessible.

Score Breakdown

Legal Compliance65/100

The tender provides reasonable submission deadlines and an appropriate CPV code. However, the contradiction of an estimated value being shown while simultaneously marked as 'classified' raises transparency concerns. The procedure type 'A' (often open) combined with a mandatory confidentiality agreement for tender documents is unusual and could be seen as a barrier, potentially conflicting with principles of transparency and equal treatment.

Contradiction: Estimated value shown but marked as classified.
Procedure type 'A' with mandatory confidentiality agreement for documents.
Clarity55/100

The tender's objective and evaluation criteria (100% lowest price) are clearly stated. However, critical technical specifications, optical maps, and the draft contract are confidential and require an NDA, significantly limiting the clarity of the full scope and performance conditions for initial assessment.

Core technical specifications and contract details are confidential and not publicly accessible.
Performance conditions are not publicly detailed, referring to the confidential contract.
Completeness50/100

Basic information, deadlines, value, and duration are provided. However, the most crucial documents, including technical specifications (Lisa 1, 1.1, 1.2), contract draft (Lisa 2), and confidentiality agreement draft (Lisa 3), are not publicly available and require an NDA, making the publicly accessible tender incomplete. Location information is also 'Undefined'.

Key technical and contractual documents are confidential and require an NDA for access.
Location information is 'Undefined'.
Fairness40/100

While e-procurement is enabled and evaluation criteria are objective (lowest price), the mandatory confidentiality agreement for tender documents creates a significant barrier to entry and limits full, equal access for all potential bidders. The high financial (400k EUR net turnover for 3 years) and technical (two 100k EUR data center contracts) requirements, for a 320k EUR contract, are substantial and may disproportionately limit competition, potentially favoring larger, established providers. The 'classified' value also reduces transparency.

Mandatory confidentiality agreement for document access creates a barrier to entry.
High financial and technical qualification requirements relative to contract value may limit competition.
Practicality55/100

Electronic submission is supported, and the duration is specified. However, the contract start date and financing information are not publicly available, referring to the confidential contract. The requirement to sign an NDA before accessing key documents adds an administrative hurdle for initial bidder assessment.

Contract start date and financing information are not publicly available.
Mandatory NDA for document access adds an administrative step.
Data Consistency60/100

Most key fields are populated, and dates are logical. However, there is a direct contradiction between the 'Estimated Value: 320,000.00 EUR' and the 'Value Classified: Yes' flag. The procedure type 'A' (often implying an open procedure) is also functionally inconsistent with the requirement for a confidentiality agreement to access documents.

Contradiction: Estimated value shown but marked as classified.
Inconsistency between procedure type 'A' and mandatory confidentiality agreement.
Sustainability20/100

The tender does not explicitly include any green procurement, social aspects, or innovation focus criteria. It is also not EU funded, which typically encourages higher sustainability standards.

No explicit green procurement criteria.
No explicit social aspects criteria.

Strengths

Clear tender objective and evaluation criteria (100% lowest price).
Electronic submission and e-procurement enabled.
Reasonable submission deadlines.
Appropriate CPV code used.

Concerns

Mandatory confidentiality agreement for accessing core tender documents.
High financial and technical qualification requirements relative to contract value.
Contradiction between disclosed estimated value and 'classified' status.
Lack of public access to full technical specifications and contract details.

Recommendations

1. Make all tender documents publicly accessible without an NDA to enhance transparency and fairness.
2. Review and justify the high qualification requirements to ensure they are proportionate and do not unduly restrict competition.
3. Clarify the status of the estimated value (classified or disclosed) to resolve data inconsistency.
