Original Tender Description

The purpose of the public procurement is to conclude a framework agreement for the ordering of construction and renovation works of real estate owned by the City of Tartu. The subject of the procurement contracts concluded on the basis of the framework agreement are construction and renovation works in administrative, residential and educational buildings and facilities managed by the City of Tartu Urban Planning Department. For the execution of the construction work, which is the subject of the tender in this public procurement, a procurement contract will be concluded in each part of the public procurement with the bidder who submitted the best offer according to the evaluation criteria, without organizing a mini-competition. Mini-competitions will be organized among the bidders who are parties to the framework agreement for the conclusion of all future procurement contracts on the basis of the framework agreement.

Tender Quality Score

This tender for construction and repair works is generally well-structured and fair, but suffers from critical data inconsistencies, particularly an invalid CPV code, and a complete lack of sustainability considerations.

Score Breakdown

Legal Compliance70/100

The tender generally adheres to standard procurement practices, utilizing ESPD and a framework agreement structure. Deadlines appear reasonable. However, the provided CPV code '5867' is not a valid 8-digit CPV code, which is a significant classification error that could impact proper advertising and competition. The procedure type (A) for an open procedure with negotiation allowed for mini-competitions is generally compliant.

Invalid CPV code (5867)
Clarity85/100

The tender description is clear, and AI-extracted requirements are well-defined and understandable. Evaluation criteria are explicitly stated as 100% price-based in Document 8 and the AI summary, despite an automated flag suggesting otherwise. Technical and financial requirements are outlined.

Completeness65/100

Basic information, estimated value, and deadlines are provided. However, the crucial duration of the framework agreement itself is not explicitly stated, only the tender validity period. Many critical documents, such as detailed price tables (XLS) and ESPD XMLs, were not analyzed by the AI, limiting a full assessment of their content.

Missing explicit duration of the framework agreement
Critical documents (price tables, ESPD XMLs) not analyzed by AI
Fairness90/100

The estimated value is disclosed, and the evaluation criteria (100% price) are objective and transparent. Electronic submission is supported, ensuring equal access. Requirements appear generic and not tailored to a specific company. The long submission period also contributes to fairness.

Practicality60/100

Electronic submission is supported, which is practical. The opening place URL is provided. However, the start date and the overall duration of the framework agreement are not explicitly stated, which can hinder bidders' long-term planning. Financing information is limited to the estimated value.

Missing explicit framework agreement start date
Missing explicit framework agreement duration
Data Consistency60/100

Most key fields are populated, and dates are logical. However, there is a significant inconsistency with the provided CPV code '5867' which is not a valid 8-digit code. There's also a contradiction between the AI-extracted content (evaluation criteria present) and the automated flag (evaluation criteria missing). The distinction between 'Tender Valid' and 'Contract Duration' is also a point of potential confusion.

Invalid CPV code
Contradiction regarding evaluation criteria (AI vs. automated flag)
Sustainability20/100

The tender does not appear to incorporate any green procurement, social aspects, or innovation focus, as indicated by the automated checks and lack of mention in the description or requirements. This represents a missed opportunity for a high-value public contract.

No green procurement criteria
No social criteria

Strengths

Clear and unambiguous tender description
Estimated value is fully disclosed
Evaluation criteria are objective and transparent (100% price)
Electronic submission and e-procurement are supported
Requirements appear generic and not tailored

Concerns

Invalid CPV code (5867) impacting legal compliance and data consistency
Missing explicit duration and start date for the framework agreement
Complete absence of sustainability, social, or innovation criteria
Critical documents (price tables, ESPD XMLs) not fully analyzed by AI
Internal contradiction regarding evaluation criteria in provided data

Recommendations

1. Correct the CPV code to a valid 8-digit classification to ensure proper advertising and legal compliance.
2. Clearly specify the duration and intended start date of the framework agreement to aid bidder planning.
3. Integrate sustainability, social, and innovation criteria to align with modern procurement best practices.
