Original Tender Description

The SEN Transport Team at WYCA is responsible for commissioning and overseeing Home to School transport contracts with taxi and minibus operators for children and young people with special education needs and disabilities on behalf of Wakefield Council. The CA is implementing this DPS in order to approve suppliers to bid on these contracts. In the past the contracts have been operated off an approved list and this DPS will work in a similar way by streamlining the process, making it easier to manage and less labour intensive for both the teams at WYCA and operators to bid against contracts.

Tender Quality Score

This tender establishes a Dynamic Purchasing System (DPS) for SEN Home to School transport services, aiming to streamline procurement. While the DPS concept is sound, the provided information lacks critical details regarding legal compliance, financial requirements, and evaluation criteria.

Score Breakdown

Legal Compliance100/100

The absence of detailed mandatory exclusion grounds and comprehensive tender documents raises significant concerns regarding legal compliance with public procurement regulations. The lack of specified evaluation criteria also poses a risk to transparent and legally sound decision-making.

No specific mandatory exclusion grounds detailed.
Zero documents attached, implying a lack of full legal framework and terms.
Clarity40/100

The overall purpose of the DPS is clearly described. However, the requirements for eligibility and technical capability are high-level, and without supporting documents or detailed criteria, the clarity for potential bidders on how their applications will be assessed is severely limited.

High-level requirements without detailed specifications or assessment methodologies.
Absence of tender documents to provide full clarity on terms and conditions.
Completeness66/100

The tender information is significantly incomplete. Key elements such as estimated value, detailed financial requirements, mandatory exclusion grounds, and all supporting tender documents are missing, which are essential for a comprehensive and fair procurement process.

Estimated value not disclosed.
No documents attached.
Fairness60/100

The lack of detailed requirements, financial criteria, and explicit evaluation methodologies could lead to subjective assessment, potentially undermining the fairness and equal treatment of bidders. Without clear exclusion grounds, the process for disqualification may also lack transparency.

Undefined evaluation criteria may lead to subjective assessment.
Absence of financial requirements could create an uneven playing field or risk.
Practicality20/100

The DPS mechanism itself is practical for recurring services like SEN transport. However, the lack of comprehensive documentation and the reported absence of e-submission could make the application process less efficient for both bidders and the contracting authority.

No e-submission (as per automated check) may hinder efficiency.
Lack of detailed guidance in documents could increase administrative burden for applicants.
Data Consistency100/100

The provided extracted data is internally consistent. The primary concern is the significant lack of data rather than inconsistencies within the available information.

Sustainability0/100

There is no mention of environmental, social, or governance (ESG) criteria. Given the nature of transporting vulnerable children, specific social considerations (e.g., driver training, safeguarding, vehicle accessibility standards) should be explicitly integrated as part of a sustainable procurement approach.

No explicit green procurement or broader sustainability criteria mentioned.
Lack of specific social considerations relevant to SEN transport (e.g., safeguarding, driver training).

Strengths

Clear purpose and description of the Dynamic Purchasing System (DPS).
Utilizes a DPS, which can be an efficient mechanism for recurring services.
Broad eligibility criteria for initial DPS entry, promoting wider market participation.
Identified specific service area (SEN Home to School transport).

Concerns

Significant lack of comprehensive documentation (zero documents attached).
Absence of detailed mandatory exclusion grounds, posing legal compliance risks.
Missing specific financial requirements for assessing bidder stability.
Undefined evaluation criteria for DPS entry, potentially leading to subjective decisions.
No estimated contract value disclosed, hindering market assessment for bidders.

Recommendations

1. Publish comprehensive tender documents, including full specifications, terms and conditions, and a detailed legal framework.
2. Clearly define and publish mandatory exclusion grounds, detailed financial requirements, and explicit evaluation criteria for DPS entry.
3. Provide an estimated contract value or range to enhance transparency and inform potential bidders.
