Original Tender Description

This contract is for the provision, API configuration to the existing LXP, and ongoing support of an online learning content aggregator/marketplace service for ECITB and in-scope employers. The Supplier will provide secure access (via subscription/licensing) to a curated catalogue of online learning content from multiple third-party providers, covering health, safety, environmental, regulatory, technical, engineering, leadership, management, business, interpersonal, and wellbeing topics. Services include a web-based portal/embeddable marketplace interface for content browsing, integration options for ECITB's LXP/LCMS (direct API integration with Learning Pool LXP), reporting/analytics on usage, and onboarding/training/support for ECITB. The Supplier is not required to develop new bespoke content. The focus is on access to and management of a large, high-quality third-party content catalogue. The Engineering Construction Industry needs broad digital learning content for compliance, safety, technical skills, leadership, and workforce development, often updated by specialist providers. Commercial "content marketplace" services aggregate courses from multiple publishers into a single library, offering tens of thousands of courses and integration with existing LXPs. ECITB aims to procure such a service to streamline access to curated third-party content for itself and participating employers, supporting its digital strategy, improving value for money, and reducing duplication. ECITB is the employer-led skills, standards, and qualifications body for the Great Britain engineering construction workforce, an arm's-length body of the UK Government, investing £28 million annually. Further information is in the procurement pack. Register interest by emailing procurement@ecitb.org.uk for the pre-tender clarification process.

Tender Quality Score

This tender provides a clear description of the required e-learning content aggregator service but is significantly hampered by missing critical documents, the absence of evaluation criteria, and a highly specific integration requirement that may limit competition.

Score Breakdown

Legal Compliance75/100

The tender defines an open procedure with a reasonable submission period and appropriate CPV codes. No disputes or suspensions are noted. However, the 'Value Classified: Yes' flag contradicts the disclosed estimated value, and the reveal date is not provided.

Inconsistent 'Value Classified' flag
Missing reveal date
Clarity70/100

The scope and AI-extracted technical requirements are clearly articulated and easy to understand. However, the absence of specified evaluation criteria creates significant ambiguity for bidders regarding how their proposals will be assessed. The inaccessible contract draft also reduces clarity on terms and conditions.

Missing evaluation criteria
Inaccessible contract draft
Completeness60/100

While basic information like title, reference, organization, value, and duration are present, the tender is critically incomplete due to the inaccessibility of the 'Schedule of Prices' and 'ECITB Services Provision Agreement (Contract Draft)' documents. The lack of evaluation criteria further diminishes completeness.

Inaccessible 'Schedule of Prices' document
Inaccessible 'Contract Draft' document
Fairness40/100

Fairness is significantly compromised by the absence of evaluation criteria, which prevents objective and transparent assessment. The requirement for 'Direct integration with Learning Pool LXP platform via API' is highly specific and could potentially tailor the tender to a limited number of suppliers. Furthermore, the inaccessibility of key documents and the lack of e-submission create barriers to equal access.

Missing evaluation criteria
Specific 'Learning Pool LXP' integration requirement
Practicality55/100

The tender's practicality is hindered by the lack of electronic submission capabilities and the inaccessibility of crucial documents like the 'Schedule of Prices' and the 'Contract Draft,' which are essential for preparing a comprehensive and compliant bid. The contract start date and duration are clearly specified.

No e-submission
Inaccessible 'Schedule of Prices' document
Data Consistency80/100

Key fields are mostly populated, and dates are logical. However, there are minor inconsistencies such as the empty 'Liable Person' field, a missing code for the 'Type: Open' procedure, and the contradiction between 'Value Classified: Yes' and the disclosed estimated value.

Empty 'Liable Person' field
Missing procedure type code
Sustainability30/100

The tender does not explicitly incorporate green procurement, social aspects, or innovation focus. It is not EU funded, which often correlates with higher sustainability standards.

No explicit green, social, or innovation criteria

Strengths

Clear and detailed description of the service scope
Well-defined technical requirements
Open procedure with a reasonable submission timeline
Estimated value and contract duration are specified
No disputes or suspensions

Concerns

Critical tender documents ('Schedule of Prices', 'Contract Draft') are inaccessible
Absence of explicit evaluation criteria
Highly specific integration requirement ('Learning Pool LXP') potentially limiting competition
Lack of electronic submission (e-submission)
No explicit sustainability or social criteria

Recommendations

1. Ensure all critical tender documents, especially the 'Schedule of Prices' and 'Contract Draft,' are fully accessible to all potential bidders.
2. Clearly define and publish the evaluation criteria to ensure transparency and fairness in the assessment process.
3. Review the specificity of the 'Learning Pool LXP' integration requirement to assess if alternative, equally effective integration methods could be considered to broaden competition.
