Original Tender Description

THIS IS NOT A CALL FOR COMPETITION. THIS IS A MARKET ENGAGEMENT. Shropshire Council is currently conducting a Preliminary Market Engagement (PME) to gather insights and feedback from potential suppliers operating within the market. The purpose of this engagement is to identify the types of solutions and functionalities available for the procurement of Community Based Care Services. This encompasses Domiciliary Care and Day care, and may, through further engagement, extend to additional areas of provision. The framework aims to consider the opportunity for implementing a comprehensive solution that covers provision for all age groups. The Council has an established procurement approach for domiciliary care through the ‘Approved Provider List’ (APL). Additionally, the FCA framework is in place for Learning Disabilities & Autism (LD&A). However, with the implementation of the Procurement Act 2023, the APL is no longer a viable option for procurement delivery. As a result, Shropshire Council is reviewing alternative models to ensure effective and compliant procurement of Community Based Care Services in the future. Tender Quality Score

This is a high-quality preliminary market engagement notice, very clear in its purpose and scope, providing a good foundation for a future procurement process. It effectively seeks market insights for compliant service delivery under new regulations.

Score Breakdown

Legal Compliance90/100

The tender clearly identifies itself as a Preliminary Market Engagement (PME), not a call for competition, which is a compliant pre-procurement activity. The CPV codes are appropriate, and there are no disputes. The reference to the Procurement Act 2023 indicates awareness of current regulations.

Clarity95/100

The tender is exceptionally clear about its purpose as a PME, explicitly stating it is not a call for competition. The description of the engagement's goals and the AI-extracted requirements are well-defined and understandable for a market engagement exercise. The explicit mention that certain tender elements (like exclusion grounds or financial requirements) are 'not applicable' for a PME further enhances clarity.

Completeness85/100

All essential information for a market engagement notice is provided, including title, reference, organization, estimated value, contract duration, and a link to the full notice. The purpose and scope of the PME are clearly outlined, and relevant documents are available.

The 'Liable Person' field is empty.
Fairness90/100

The PME promotes fairness by seeking broad market input and providing full access to information via a URL. The requirements are generic and not tailored, ensuring equal opportunity for all potential suppliers to engage. The estimated value is disclosed, which aids market participants.

The 'Value Classified: Yes' alongside the stated value is a minor inconsistency.
Practicality85/100

The provision of a direct URL to the e-sourcing platform (delta-esourcing.com) makes it practical for interested parties to access the full notice and engage. Key dates like contract start and duration are specified, aiding future planning.

The automated check flagged 'No e-submission,' which might be misleading for a PME where formal tender submission is not the goal. However, the platform itself implies electronic interaction for feedback.
Data Consistency90/100

The data provided is largely consistent. Dates are logical, and there are no reported disputes or suspensions. The 'Type' and 'Procedure' being 'None' is consistent with a Preliminary Market Engagement.

The 'Liable Person' field is empty.
The 'Value Classified: Yes' alongside the stated value is a minor inconsistency.
Sustainability60/100

While the tender concerns 'Community Based Care Services,' which inherently have social value, there are no explicit criteria or focus on broader green procurement practices or specific social clauses within the procurement process itself. However, the PME's aim to 'identify the types of solutions and functionalities available' suggests an openness to innovative approaches, which can contribute to sustainability.

Lack of explicit green procurement or social criteria for the procurement process.

Strengths

Clear identification as a Preliminary Market Engagement.
Comprehensive description of purpose and scope.
Transparent disclosure of estimated value and key timelines.
Use of an e-sourcing platform for accessibility.
Focus on gathering market insights for future compliant procurement.

Concerns

Lack of explicit green procurement or social criteria.
Minor data inconsistencies (e.g., 'Value Classified: Yes' vs. stated value, empty 'Liable Person').
The automated flag 'No e-submission' could be misinterpreted, though less critical for a PME.

Recommendations

1. Explicitly encourage suppliers to propose sustainable and socially responsible solutions during the market engagement.
2. Ensure all fields, such as 'Liable Person,' are populated in future notices for full transparency.
3. Clarify the method for submitting feedback/insights within the PME notice to avoid confusion regarding 'e-submission.'
