Original Tender Description

THIS IS NOT A CALL FOR COMPETITION. THIS IS A MARKET ENGAGEMENT. Shropshire Council is currently conducting a Preliminary Market Engagement (PME) to gather insights and feedback from potential suppliers operating within the market. The purpose of this engagement is to identify the types of solutions and functionalities available for the procurement of Community Based Care Services. This encompasses Domiciliary Care and Day care, and may, through further engagement, extend to additional areas of provision. The framework aims to consider the opportunity for implementing a comprehensive solution that covers provision for all age groups. The Council has an established procurement approach for domiciliary care through the ‘Approved Provider List’ (APL). Additionally, the FCA framework is in place for Learning Disabilities & Autism (LD&A). However, with the implementation of the Procurement Act 2023, the APL is no longer a viable option for procurement delivery. As a result, Shropshire Council is reviewing alternative models to ensure effective and compliant procurement of Community Based Care Services in the future. Tender Quality Score

This is a well-structured Preliminary Market Engagement (PME) notice, clearly outlining its purpose to gather market insights for future Community Based Care Services procurement. While excellent in clarity and data consistency for a PME, it could benefit from explicitly incorporating sustainability and social value considerations into the engagement scope.

Score Breakdown

Legal Compliance80/100

As a Preliminary Market Engagement (PME), the notice correctly identifies itself as 'not a call for competition' and 'Type: None', which is compliant. The CPV code is appropriate, and the deadline for engagement is reasonable. It references the Procurement Act 2023, indicating awareness of national regulations.

Clarity90/100

The description is exceptionally clear and unambiguous, explicitly stating the purpose of the PME and the context for reviewing procurement models. The AI-extracted requirements clearly differentiate what is not applicable for a PME (e.g., exclusion, eligibility, financial criteria) from what is expected (participation, feedback).

Completeness75/100

Most essential information is provided, including title, reference, organization, estimated value, contract duration, and start date. Location (NUTS code) is also present. A minor issue is one document failing to download and the 'Value Classified: Yes' flag despite the value being displayed.

One document failed to download.
Contradiction: 'Value Classified: Yes' while the estimated value is displayed.
Fairness85/100

The PME approach itself promotes fairness by seeking broad market input before defining a formal tender. The estimated value is disclosed, and the requirements for PME participation are generic and not tailored. The deadline for engagement is reasonable.

Practicality70/100

The document URL, contract start date, and duration are clearly specified. However, the automated check flags 'No e-submission', and the method for submitting PME feedback is not explicitly detailed, which could slightly hinder ease of participation.

Method for submitting PME feedback is not explicitly detailed.
Automated check flagged 'No e-submission'.
Data Consistency90/100

The data is largely consistent and logical. Dates are in order, and there are no reported disputes or suspensions. Minor inconsistencies include an empty 'Liable Person' field and the 'Value Classified: Yes' flag despite the value being visible.

Liable Person field is empty.
Contradiction: 'Value Classified: Yes' while the estimated value is displayed.
Sustainability40/100

The PME does not explicitly mention or seek feedback on green procurement, social aspects (beyond the inherent nature of community care services), or innovation focus for the future framework. This represents a missed opportunity to integrate sustainability considerations from the initial market engagement phase.

No explicit mention of green procurement criteria.
No explicit mention of social criteria for the future tender.

Strengths

Clear definition as a Preliminary Market Engagement (PME).
Comprehensive description of purpose and context.
Reasonable deadline for market engagement feedback.
Estimated value and contract duration/start date are disclosed.
Use of Delta eSourcing platform for notice dissemination.

Concerns

Lack of explicit detail on how to submit PME feedback.
No explicit focus on sustainability (green, social, innovation) in the PME scope.
One document failed to download.
Minor data inconsistencies (e.g., 'Value Classified: Yes' vs. displayed value).

Recommendations

1. Clearly specify the method for submitting feedback for the Preliminary Market Engagement.
2. Integrate explicit questions or topics related to sustainability, social value, and innovation into the PME to inform future tender design.
3. Ensure all linked documents are accessible and resolve any data inconsistencies.
