Tender Quality Score

This tender for a Barristers Framework Agreement is severely lacking in critical documentation and detailed requirements, which significantly undermines transparency, fairness, and the ability for bidders to submit comprehensive offers.

Score Breakdown

Legal Compliance100/100

The tender specifies an 'Open procedure', which aligns with basic procurement principles. However, the absence of detailed mandatory exclusion grounds and specific selection criteria (eligibility, financial, technical) in the provided information is a significant concern regarding legal compliance and adherence to procurement regulations.

Lack of detailed mandatory exclusion grounds.
Absence of specific selection criteria (eligibility, financial, technical) as typically required by procurement law.
Clarity40/100

While the overall objective of establishing a Barristers Framework for WMLA is clear, the specific details required from bidders, the evaluation methodology, and the precise scope of legal services are extremely vague due to the complete absence of tender documents and specific requirements.

Vague eligibility and technical requirements.
Absence of evaluation criteria.
Completeness83/100

This is the tender's weakest aspect. There are '0 total' documents, and the 'EXTRACTED REQUIREMENTS' are high-level statements rather than detailed, measurable criteria. Critical omissions include evaluation criteria, specific financial requirements, and detailed technical specifications.

No tender documents attached.
Missing detailed eligibility criteria.
Fairness60/100

The 'Open procedure' generally promotes fairness. However, the extreme lack of detail in requirements and the absence of evaluation criteria make it difficult for potential bidders to understand what is truly expected and how they will be judged. This could lead to subjective assessments and potentially unequal treatment, raising concerns about the fairness of the process.

Lack of clear and objective evaluation criteria.
Vague requirements that could lead to subjective assessment.
Practicality40/100

For bidders, it is highly impractical to prepare a high-quality, competitive bid without any supporting documents or detailed requirements. For the contracting authority, evaluating bids based on such vague criteria would be challenging, prone to disputes, and inefficient.

Difficult for bidders to prepare comprehensive and competitive offers.
Challenging for the contracting authority to conduct a fair and objective evaluation.
Data Consistency100/100

The limited data provided is internally consistent (e.g., title matches description, reference number is present). The primary issue is the *absence* of critical data points, which is highlighted by the automated check results.

Sustainability0/100

The automated check results explicitly state 'Not green procurement', 'No social criteria', and 'No innovation focus', indicating a complete absence of sustainability and innovation considerations within the tender's scope.

No green procurement criteria.
No social criteria.

Strengths

Clear objective for establishing a Barristers Framework.
Open procedure promotes broad competition.
Estimated contract value is disclosed.
Identified as a new procurement, suggesting a fresh approach.
Framework agreement structure is suitable for ongoing legal services.

Concerns

Critical: No tender documents attached, making it impossible for bidders to understand the full scope and requirements.
Critical: Absence of detailed eligibility, technical, and financial requirements, leading to extreme vagueness.
Critical: Missing evaluation criteria, which is a fundamental flaw for a fair and transparent procurement process.
Lack of specific mandatory exclusion grounds.
No consideration for green, social, or innovation aspects.

Recommendations

1. Publish comprehensive tender documents, including detailed specifications, eligibility criteria, selection criteria, and award criteria.
2. Clearly define mandatory exclusion grounds and specific financial and technical requirements to ensure legal compliance and fairness.
3. Integrate sustainability (green and social) and innovation criteria where appropriate for legal services to promote broader public value.
