Original Tender Description

Hertfordshire County Council (HCC) is undertaking work to explore opportunities to strengthen the local supply of nursing home provision. As demand grows with an ageing population, we want to ensure Hertfordshire has a resilient, high quality and future proof accommodation market. This includes increasing the availability of nursing, Extra Care and specialist provision, attracting sustainable investment, and ensuring supply aligns with population need. We are seeking the views of nursing home operators to understand how the Council can support their expansion, including through the Council supporting investment into new homes or the Council developing new assets as a landlord. This is part of a wider engagement, working in partnership with developers, investors and providers, we are aiming to understand how we can expand capacity, improve long term sustainability, and ensure residents can access modern, affordable and high quality accommodation that meets their needs. The Council is carrying out PME in relation to this project. The Council will consider the feedback received to help inform the Council’s options, requirements and further decision making. For the avoidance of doubt, this stage of the project is not part of a formal procurement process and the Council is not committing, at this stage, to carrying out such a process. Participation or non-participation in the PME shall not prevent any supplier participating in a potential future procurement, nor is it intended that any information supplied as part of the PME shall place any supplier at an advantage in a potential procurement process. For further information, please see the PME Document. If your organisation is not registered on the Supply Hertfordshire In-tend portal, please go to the website stated above and click on the `Register` tab - registration is free. Logging into In-Tend (once registered) - To view this opportunity please click on `Tenders` then `Current` and then scroll down to the project. - Selecting ‘View Details’ on the relevant opportunity - Clicking the ‘Express Interest’ tab - Following the on-screen instructions - The Questionnaire & more information is available via the PME Documents tab. Completed questionnaires should be returned via the Correspondence function on this project and we would appreciate these by 12 noon on Friday 20th February. All communication should be via the Correspondence function on the project. To ensure you receive email alerts and notifications from our system, please add the email domain `@in-tendorganiser.co.uk` to your Safe Senders list. Please note that the e-noticing system requires a contract start and end date. The dates stated below are not accurate as any start date is subject to any future procurement which is not guaranteed at this stage.

Tender Quality Score

This Preliminary Market Engagement (PME) is clearly articulated in its purpose and offers fair access, but suffers from critical data inconsistencies regarding deadlines and a lack of definitive financial and timeline information.

Score Breakdown

Legal Compliance75/100

The PME clearly defines its non-formal nature and aims to comply with principles of fair market engagement. The 16-day period for questionnaire submission is reasonable for a PME, and the CPV code is appropriate. However, the conflicting submission dates in the system create ambiguity.

Conflicting submission deadlines (system vs. PME document)
Clarity80/100

The purpose and scope of the Preliminary Market Engagement are exceptionally clear. The description explicitly states it is not a formal procurement and outlines the council's objectives. AI-extracted requirements are well-structured and understandable, and the lack of evaluation criteria is appropriate for a PME.

Completeness70/100

Basic information like title, organization, and reference is complete, and documents are attached. However, the estimated value is not disclosed, and contract duration/start dates are explicitly stated as inaccurate, which, while understandable for a PME, still represents a lack of definitive information. The conflicting deadlines also detract from completeness.

Value not disclosed
Contract duration/start dates explicitly inaccurate
Fairness85/100

The PME explicitly states that participation or non-participation will not prejudice future procurement, which is a strong indicator of fairness. Requirements are broad and not tailored. Full document access and e-procurement via a portal ensure equal access.

Value not disclosed (minor point for PME)
Practicality65/100

Electronic submission via the In-tend portal is supported, which is practical. However, the lack of a direct document URL and the explicitly inaccurate contract dates and undisclosed value reduce the practicality for potential respondents to fully plan or assess the future opportunity.

No direct document URL
Inaccurate contract dates
Data Consistency40/100

This category presents the most significant concern. The 'Submission Deadline' of 2026-03-13 directly contradicts the 'Completed questionnaires should be returned by 12 noon on Friday 20th February' (2026-02-20). Additionally, the system-required contract start and end dates are explicitly stated as inaccurate, highlighting an inconsistency between system fields and actual project status.

Critical inconsistency between system submission deadline and PME questionnaire deadline
Explicit inaccuracy of contract start/end dates
Sustainability50/100

The project's overarching goal is to develop 'sustainable nursing home provision' and 'improve long term sustainability,' which inherently aligns with sustainability principles. However, the PME documentation itself does not include specific green, social, or innovation criteria for the market engagement participants or for the future procurement process.

No explicit green, social, or innovation criteria within the PME requirements

Strengths

Clear purpose and scope of the Preliminary Market Engagement (PME)
Fair and broad requirements for market participants
Explicit statement that PME participation will not prejudice future procurement
Electronic submission supported via a dedicated portal
Detailed instructions for portal use

Concerns

Critical inconsistency between the system's 'Submission Deadline' and the PME questionnaire deadline
Estimated value is not disclosed and classified
Contract duration and start dates are explicitly stated as inaccurate
Generic 'Type: None' and 'Procedure: None' fields, despite clear PME description
No direct URL provided for the PME document

Recommendations

1. Immediately clarify and correct the conflicting submission deadlines to avoid confusion for potential participants.
2. Consider providing a direct URL to the PME document for easier access.
3. For future market engagements, ensure system-generated dates are either accurate or clearly marked as placeholders without conflicting with actual deadlines.
