Original Tender Description

United Utilities is committed to building a greener energy portfolio that reduces operational carbon emissions and supports our ambition to achieve net‑zero greenhouse gas emissions by 2050. As one of the largest water and wastewater service providers in the UK, we operate more than 100 water treatment works and 575 wastewater treatment works across the North West of England. These sites have significant energy demands and require robust power resilience to maintain essential services for our customers. Our operational footprint across the region presents substantial opportunities to integrate low‑carbon and renewable energy solutions. Many of our sites have available land or roof space suitable for on‑site generation. In addition, we are seeking opportunities for work with existing or upcoming renewable generation assets close to our operational sites to develop private‑wire Power Purchase Agreements (PPAs). Together, these opportunities support our drive to reduce operational emissions and contribute to a greener, stronger, and healthier North West. To advance this ambition, we are seeking long‑term Power Purchase Agreements through a procurement process structured into three parts: Part 1: Existing Generation: Low‑carbon or renewable generation assets that are currently available—or expected to become available—for private‑wire connection within the North West of England. Part 2: Site‑Based Development: Low‑carbon or renewable generation projects that can be developed on United Utilities‑owned land within the region. Part 3: Site‑Based Development (Roof‑Mounted): Solar PV installations that can be developed on suitable roof areas across United Utilities’ property portfolio in the North West. Suppliers may bid for all three parts or select any individual part that aligns with their expertise, capabilities, and experience.

Tender Quality Score

This tender demonstrates a strong commitment to sustainability and renewable energy, clearly outlining its environmental objectives and project parts. However, it suffers from significant deficiencies in legal compliance, clarity, and fairness due to contradictory procedure definitions, missing mandatory exclusion grounds, and a complete absence of evaluation criteria.

Score Breakdown

Legal Compliance55/100

The tender exhibits significant legal compliance issues, primarily due to the contradictory definition of the procurement procedure (listed as 'Open' type but 'Dynamic market' procedure) and the absence of specific mandatory exclusion grounds. While the CPV code is appropriate and the deadline is reasonable (30 days), these fundamental omissions pose a high risk of non-compliance with procurement regulations.

Contradictory procurement procedure type ('Open' vs 'Dynamic market')
Missing specific mandatory exclusion grounds
Clarity50/100

The project description is clear regarding the organization's sustainability goals and the three parts of the procurement. However, the overall clarity for potential bidders is severely hampered by the complete absence of evaluation criteria, unspecified financial requirements, and the lack of detailed performance conditions beyond general statements. This makes it difficult for suppliers to understand how their bids will be assessed.

No evaluation criteria specified
No specific financial requirements detailed
Completeness50/100

While basic information like title, reference, organization, and CPV code are present, the tender is incomplete in several critical areas. Key missing elements include the contract duration (despite being 'long-term' PPAs), specific financial requirements, mandatory exclusion grounds, and crucially, the evaluation criteria. The estimated value is classified, which, while sometimes acceptable for PPAs, contributes to a lack of full transparency.

Missing contract duration
Missing specific financial requirements
Fairness45/100

Fairness is significantly compromised by the absence of evaluation criteria, which prevents objective and transparent assessment of bids. The lack of e-submission capabilities also creates a barrier to equal access for all potential suppliers. While the requirements appear generic and the division into parts offers flexibility, the classified value and the aforementioned issues reduce overall transparency and fairness.

No evaluation criteria specified
No e-submission supported
Practicality40/100

The tender's practicality is low due to several missing key details. The absence of electronic submission capabilities is a significant practical drawback in modern procurement. Furthermore, the lack of a specified contract start date and, most importantly, the duration for 'long-term' PPAs, makes it challenging for bidders to formulate comprehensive and practical proposals.

No electronic submission supported
Missing contract start date
Data Consistency60/100

The primary data consistency issue lies in the contradictory classification of the procurement procedure, being listed as 'Open' type but 'Dynamic market' procedure, both with empty codes. The 'Liable Person' field is also empty. Other key fields are populated and consistent, and there are no reported disputes or suspensions.

Contradictory procurement procedure type ('Open' vs 'Dynamic market')
Empty codes for procedure type and procedure
Sustainability70/100

The tender scores well on sustainability, with a clear and strong focus on green procurement. The description explicitly outlines the commitment to a greener energy portfolio, reducing carbon emissions, and achieving net-zero goals through low-carbon and renewable energy solutions. However, it lacks explicit social criteria and a defined focus on innovation within the requirements, which could further enhance its sustainability profile.

No explicit social criteria included
No explicit innovation focus in requirements

Strengths

Strong commitment to green procurement and sustainability goals
Clear and detailed project description with three distinct parts
CPV code appropriately assigned for the services sought
Documents are available and summarized

Concerns

Contradictory procurement procedure definition ('Open' vs 'Dynamic market')
Complete absence of evaluation criteria
Missing mandatory exclusion grounds and financial requirements
No electronic submission capabilities
Missing contract duration and start date

Recommendations

1. Clarify and consistently define the procurement procedure (e.g., Open procedure or Dynamic Purchasing System) and provide relevant codes.
2. Immediately publish comprehensive evaluation criteria, including financial requirements and mandatory exclusion grounds, to ensure fairness and transparency.
3. Implement electronic submission for bids to enhance accessibility and efficiency for all potential suppliers.
