Original Tender Description

Derbyshire County Council is seeking an experienced single Contractor to provide maintenance works and repairs to Harrington Bridge, in Sawley. Phase 2 works comprise of following works to the structure: Replacement of existing severely corroded cross bracing sections at the pier, paint the caissons and connection to the bracing. Minor remedial works to the apron in front of the abutments. The existing bridge deck expansion joints are to be replaced, partially resurface the carriageway and resurface the footways. In order to carry out the works at the pier, a temporary suspended platform will be required to provide a dry and safe working environment at the pier. Temporary scaffolding / platform over the bridge is also required for the access to the works. The Contractor's attention is drawn to the fact that River Trent in this area is very fast flowing and subject to flash flooding. The 1 in 20 years flood level is 31.27mAOD which is above the bottom flange level. All temporary works design is to comply to the Special Requirements of Environment Agency and all current design codes. Temporary works platform to have independent CAT 3 checks.

Tender Quality Score

This tender provides a clear description of complex bridge maintenance works but suffers from critical omissions, including the complete absence of tender documents and evaluation criteria.

Score Breakdown

Legal Compliance100/100

The tender appears generally compliant with basic principles for an open competition below threshold. However, the lack of explicit mandatory exclusion grounds and the complete absence of full tender documents raise significant concerns regarding transparency and equal treatment of bidders.

Clarity40/100

The description of the required works is highly detailed and clear, outlining specific tasks, materials, and environmental challenges, which is a strength for potential bidders to understand the scope.

Completeness83/100

This tender is severely lacking in completeness. The complete absence of essential tender documents (e.g., detailed specifications, drawings, bill of quantities, contract terms, instructions to bidders) and explicit evaluation criteria makes it impossible for bidders to prepare a comprehensive and compliant offer.

Fairness60/100

The 'single Contractor' requirement is standard for works contracts. While the technical requirements are highly specific and demanding, they appear to reflect the project's inherent complexity and risks (e.g., fast-flowing river, CAT 3 checks) rather than being overtly tailored to a specific company. However, the absence of evaluation criteria makes it impossible to assess how bids will be fairly judged.

Practicality40/100

The detailed technical requirements are practical for ensuring project success, especially regarding temporary works design, environmental compliance, and safety in a challenging river environment. The 7-month contract duration seems achievable for an experienced contractor given the scope.

Data Consistency100/100

A minor inconsistency exists in the estimated value, stated as '420,000.00 EUR' in the financial information and later as '£420,000 (or 420,000 EUR)' in the financial requirements. This should be clarified.

Sustainability0/100

No explicit green procurement, social, or innovation criteria are mentioned. This indicates a missed opportunity to integrate broader sustainability objectives into the procurement process.

Strengths

Clear and detailed description of the scope of works, including specific tasks and environmental challenges.
Open competition procedure, promoting broader participation.
Specific technical requirements addressing project complexities (e.g., fast-flowing river, CAT 3 checks) ensure necessary expertise.

Concerns

Complete absence of essential tender documents (specifications, drawings, contract terms, etc.).
Missing explicit evaluation criteria for bid assessment, hindering transparency and fairness.
Lack of explicit mandatory exclusion grounds, which are standard in public procurement.
Minor currency inconsistency in the estimated value (£ vs EUR).
No integration of sustainability (green, social, innovation) criteria.

Recommendations

1. Immediately publish all essential tender documents, including detailed specifications, drawings, contract terms, and instructions to bidders.
2. Clearly define and publish the evaluation criteria and their weighting to ensure transparency and fair assessment of bids.
3. Include standard mandatory and discretionary exclusion grounds as per relevant procurement regulations.
