Tender Quality Score

This tender for a Dynamic Purchasing System is severely lacking in essential documentation and detailed requirements, raising significant concerns regarding legal compliance, transparency, and fairness despite its clear objective and substantial value.

Score Breakdown

Legal Compliance100/100

The tender exhibits critical legal compliance issues, notably the explicit absence of mandatory exclusion grounds and specific financial requirements, which are fundamental for public procurement. Furthermore, classifying a Dynamic Purchasing System (DPS) as a 'Restricted procedure' is a procedural inconsistency, as DPS is inherently an open procedure.

Absence of mandatory exclusion grounds
Absence of specific financial requirements
Clarity40/100

While the overall objective and basic eligibility criteria are stated, the tender suffers from a profound lack of clarity due to the complete absence of detailed tender documents, specific technical specifications, and, crucially, evaluation criteria. This makes it impossible for potential bidders to understand the full scope or how their submissions will be assessed.

No tender documents available
Missing detailed technical specifications
Completeness83/100

The tender is critically incomplete. The absence of any attached documents, detailed financial requirements, specific technical criteria beyond general statements, and evaluation criteria renders it insufficient for a compliant and competitive procurement process.

No tender documents attached
Missing detailed financial requirements
Fairness80/100

The severe lack of detailed requirements, particularly the absence of evaluation criteria and specific financial thresholds, creates a high risk of an unfair and non-transparent procurement process. Without clear, pre-defined rules, the contracting authority retains excessive discretion, potentially leading to arbitrary selection and hindering fair competition.

Absence of evaluation criteria
Lack of specific financial requirements
Practicality40/100

While the DPS mechanism itself is practical for ongoing recruitment needs, the current state of the tender documentation makes it highly impractical for potential suppliers. Bidders cannot adequately prepare competitive applications without access to full tender documents, detailed requirements, and clear evaluation methods.

Bidders cannot adequately prepare submissions due to missing documents and detailed criteria
Operational challenges for the contracting authority in managing a process without clear rules
Data Consistency100/100

A significant inconsistency exists in classifying the Dynamic Purchasing System (DPS) under a 'Restricted procedure.' DPS is a specific type of procurement procedure that is open throughout its validity period, allowing any economic operator meeting the selection criteria to join, which contradicts the nature of a restricted procedure.

Inconsistency between 'Restricted procedure' and 'Dynamic Purchasing System' classification
Sustainability0/100

The provided information does not include any details regarding green procurement, social criteria, or innovation focus. This indicates a missed opportunity to integrate broader sustainability objectives into this significant public contract.

No green procurement criteria specified
No social criteria specified

Strengths

Clear objective to establish a flexible Dynamic Purchasing System for temporary and interim staff
Substantial estimated value of 100,000,000 EUR, likely to attract a wide range of suppliers
Long contract duration of 72 months, offering stability for successful suppliers
Use of a DPS allows for new entrants throughout its term, promoting competition over time

Concerns

Complete absence of tender documents, making it impossible for bidders to understand the full scope
Missing mandatory exclusion grounds, a fundamental legal requirement for public procurement
Lack of specific financial requirements (e.g., minimum turnover, insurance), hindering fair assessment of financial capacity
Absence of any evaluation criteria, leading to a non-transparent and potentially arbitrary selection process
Inconsistency in classifying a Dynamic Purchasing System as a 'Restricted procedure'

Recommendations

1. Immediately publish all comprehensive tender documents, including detailed specifications and terms and conditions.
2. Clearly define and publish mandatory exclusion grounds, specific financial requirements, and detailed technical criteria.
3. Rectify the procedural classification to accurately reflect a Dynamic Purchasing System as an open procedure, and provide clear evaluation criteria for joining the DPS.
