Original Tender Description

Project Summary: Rochdale Borough Council is progressing the development of a new Special Educational Needs (SEN) Pupil Referral Unit (PRU) on the Mayfield Street site (Rochdale, OL16 2UZ). The new facility will deliver provision for 64 pupils aged 11-16 with Social, Emotional and Mental Health (SEMH) needs. The scheme aims to create a secure, high-quality, and therapeutically informed learning environment designed to support vulnerable pupils and enable staff to deliver specialist SEN provision effectively. The project is currently completing RIBA Stage 3: Spatial Coordination, following completion of RIBA Stage 2. The Council now intends to procure a suitably experienced Design & Build Contractor to support the scheme's development through a two-stage procurement process. Scope of Contractor Appointment: The appointed contractor will: • Participate in a competitive two-stage tender process, commencing with shortlisting of five contractors. • Enter into a Pre-Construction Services Agreement (PCSA) at the start of RIBA Stage 4: Technical Design, working collaboratively with the client and design team to develop the design, plan construction activities, inform cost development, and support risk mitigation. • Upon successful completion of the PCSA and agreement of contract sum, enter into a JCT Design & Build Contract 2024 for delivery of the construction works. The contractor will be expected to demonstrate: • Proven experience in delivering education project or similar public sector schemes. • Strong capability in pre-construction collaboration, buildability input, and cost planning. • A robust approach to quality, safety, safeguarding, stakeholder coordination, and social value delivery. Tender Quality Score

The tender outlines a two-stage restricted procedure for a significant SEN PRU project, emphasizing collaboration and social value. However, critical information regarding mandatory exclusion grounds and evaluation criteria is missing from the provided notice, impacting transparency and fairness.

Score Breakdown

Legal Compliance100/100

The tender notice explicitly states that mandatory exclusion grounds are not specified, which is a significant legal omission for public procurement, potentially allowing ineligible bidders to participate and failing to meet basic compliance standards.

Absence of specified mandatory exclusion grounds.
Clarity40/100

The project scope, two-stage process, and contractor expectations are clearly articulated. The use of RIBA stages and JCT contract types provides a clear and understandable framework for the project delivery.

Completeness83/100

While the notice provides a good overview of the project and process, the absence of mandatory exclusion grounds and, crucially, evaluation criteria makes the tender incomplete. The actual tender documents (1A, 3A) are referenced but not provided for full assessment.

Missing mandatory exclusion grounds.
Missing evaluation criteria for both stages of the procurement.
Fairness60/100

The lack of mandatory exclusion grounds and evaluation criteria severely impacts the fairness and transparency of the process, as bidders cannot fully understand the rules for participation or how their submissions will be judged. This creates an uneven playing field.

Absence of specified mandatory exclusion grounds.
Lack of clear evaluation criteria for shortlisting and contract award.
Practicality40/100

The two-stage approach with a Pre-Construction Services Agreement (PCSA) is a practical and effective method for complex Design & Build projects, allowing for collaborative design development, risk mitigation, and cost finalization before committing to the main construction contract.

Data Consistency100/100

The information provided within the tender notice is consistent, with no conflicting details regarding the project, procurement process, or stated requirements.

Sustainability50/100

The tender explicitly includes 'Social Criteria' and requires a 'robust approach to social value delivery,' indicating a commitment to social sustainability. 'Innovation Focus' is also a positive characteristic. However, environmental aspects ('green procurement') are not explicitly highlighted in the provided text.

Strengths

Clear project description and scope.
Utilizes a practical two-stage Design & Build procurement process with PCSA.
Emphasis on social value delivery and innovation.
Well-defined contractor expectations for collaboration and technical capability.

Concerns

Absence of specified mandatory exclusion grounds.
Critical lack of evaluation criteria for both stages of the procurement.
Full tender documents (1A, 3A) are referenced but not available for comprehensive review.
Potential for reduced transparency and fairness due to missing key information.

Recommendations

1. Publish comprehensive mandatory exclusion grounds in accordance with relevant procurement regulations.
2. Clearly define and publish all evaluation criteria and their weighting for both the shortlisting stage and the final tender stage.
3. Ensure all associated tender documents are readily accessible and complete for potential bidders.
