Original Tender Description

THIS IS NOT A CALL FOR COMPETITION. THIS IS A MARKET ENGAGEMENT. Shropshire Council is currently conducting a Preliminary Market Engagement (PME) to gather insights and feedback from potential suppliers operating within the market. The purpose of this engagement is to identify the types of solutions and functionalities available for the procurement of Accommodation Based Care Services. This encompasses Care Homes and supported living, and may, through further engagement, extend to additional areas of provision. The framework aims to consider the opportunity for implementing a comprehensive solution that covers provision for all age groups. The Council has an established procurement approach for Care Home Placements through the ‘Approved Provider List’ (APL). Additionally, the FCA framework is in place for Learning Disabilities & Autism (LD&A). However, with the implementation of the Procurement Act 2023, the APL is no longer a viable option for procurement delivery. As a result, Shropshire Council is reviewing alternative models to ensure effective and compliant procurement of Accommodation Based Care Services in the future. Tender Quality Score

This is a well-structured Preliminary Market Engagement (PME) notice, clearly outlining its purpose to gather market insights for future Accommodation Based Care Services procurement under the new Procurement Act 2023. While comprehensive for a PME, it naturally lacks the detailed requirements of a full tender.

Score Breakdown

Legal Compliance90/100

The notice clearly defines itself as a PME, not a call for competition, and explicitly references the new Procurement Act 2023, demonstrating legal awareness and compliance for this pre-procurement stage. The CPV code is appropriate, and there are no disputes.

Clarity85/100

The description is highly clear and unambiguous about the nature and purpose of the market engagement. It explicitly states that no bidding requirements are applicable at this stage, which is appropriate for a PME.

Completeness75/100

The notice provides all essential information for a Preliminary Market Engagement, including the estimated value, contract duration, and start date. However, as it is not a full tender, detailed requirements and evaluation criteria are absent, and one document summary failed to load.

Absence of detailed tender requirements and evaluation criteria (inherent to PME, but a future need)
Download failed for one document summary
Fairness90/100

The PME approach itself promotes fairness by seeking broad market input before defining the tender, ensuring no specific company is favored. Full document access is provided, and the estimated value is disclosed.

Practicality70/100

A document URL is provided, and key contract dates are specified. While the automated check flagged 'No e-submission,' the use of an e-sourcing platform (Delta) typically facilitates electronic interaction for market engagement responses.

Automated check flagged 'No e-submission' (if true for PME response)
Download failed for one document summary
Data Consistency90/100

Key fields are largely populated, and dates are logical. Minor inconsistencies, such as 'Value Classified: Yes' despite the value being disclosed, do not significantly detract from overall consistency.

'Value Classified: Yes' despite value being disclosed creates minor ambiguity
Sustainability50/100

The notice does not explicitly mention any green procurement, social criteria beyond the inherent nature of care services, or innovation focus within the procurement process itself.

Lack of explicit sustainability (green, social, innovation) criteria

Strengths

Clear definition as a Preliminary Market Engagement
Explicit reference to the new Procurement Act 2023
Estimated contract value and duration clearly stated
Use of an e-sourcing platform for engagement
Appropriate CPV code

Concerns

Absence of detailed tender requirements and evaluation criteria (inherent to PME, but a future need)
Download failed for one document summary
Lack of explicit sustainability (green, social, innovation) criteria
'Value Classified: Yes' despite value being disclosed creates minor ambiguity
'No e-submission' flagged by automated check (if true for PME response)

Recommendations

1. Ensure all future tender documents are fully accessible and summarized.
2. Consider incorporating explicit sustainability and innovation criteria in the subsequent tender.
3. Clearly communicate the method for submitting feedback for the PME via the e-sourcing platform.
