Original Tender Description

THIS IS NOT A CALL FOR COMPETITION. THIS IS A MARKET ENGAGEMENT. Shropshire Council is conducting a Preliminary Market Engagement (PME) to gather insights and feedback from potential suppliers operating within the market. The purpose is to identify available solutions and functionalities for the procurement of Community Based Care Services, encompassing Domiciliary Care and Day care, and potentially extending to additional areas. The framework aims to cover all age groups. The Council has an 'Approved Provider List' (APL) for domiciliary care and an FCA framework for Learning Disabilities & Autism (LD&A). However, due to the Procurement Act 2023, the APL is no longer viable. Shropshire Council is reviewing alternative models for effective and compliant procurement of Community Based Care Services. Tender Quality Score

This is a well-structured Preliminary Market Engagement (PME) by Shropshire Council, proactively addressing new procurement legislation for significant community-based care services. While not a formal tender, it clearly outlines its purpose, scope, and requirements for market participation, demonstrating good transparency and a forward-thinking approach.

Score Breakdown

Legal Compliance85/100

The tender clearly identifies itself as a Preliminary Market Engagement, not a call for competition, which is appropriate. It demonstrates awareness and proactive steps towards compliance with the new Procurement Act 2023. CPV codes are correctly assigned, and there are no reported disputes or suspensions. Deadlines are reasonable for a market engagement.

Clarity90/100

The description is exceptionally clear, unambiguously stating the purpose and scope of the PME. Requirements for participation are well-documented and understandable, explicitly noting what is not required for this engagement phase. The absence of formal evaluation criteria is expected for a PME.

Completeness90/100

All basic information, including title, reference, organization, estimated value, duration, and location (NUTS code), is provided. The purpose and requirements for market engagement are clearly defined. All listed documents are available and summarized, contributing to a comprehensive overview for a PME.

Fairness90/100

Full document access is provided via a link to an e-sourcing platform. The significant estimated value is disclosed, promoting transparency. Requirements for participation are generic and not tailored to any specific company, ensuring equal access for potential suppliers. Deadlines are reasonable for market engagement.

Practicality80/100

A document URL is provided, leading to an e-sourcing platform, which implies electronic engagement is supported. The contract start date and duration are clearly specified, along with financing information. While 'No e-submission' is flagged, for a PME, electronic interaction via the platform is generally practical.

Ambiguity regarding the exact method of 'e-submission' for a PME, despite using an e-sourcing platform.
Data Consistency95/100

Key fields are consistently populated, and the information provided is logical and coherent. The status is 'planning' with no disputes, which aligns with a preliminary market engagement. Dates are logical, with the contract start date well after the PME deadline.

Sustainability30/100

The tender does not explicitly mention any green procurement, social criteria (beyond the inherent nature of the service), or innovation focus within the procurement process itself. This represents a missed opportunity to explore these aspects during the market engagement phase.

No explicit mention of green procurement criteria.
No explicit mention of social criteria for the procurement process.

Strengths

Clear identification as a Preliminary Market Engagement, not a call for competition.
Proactive approach to new Procurement Act 2023.
Clear description of purpose, scope, and requirements for engagement.
Significant estimated value disclosed, indicating a major future opportunity.
Use of an e-sourcing platform for market engagement.

Concerns

Lack of explicit mention of sustainability, social, or innovation criteria for the future procurement.
The 'Value Classified: Yes' alongside a disclosed value could be slightly ambiguous, though the value is visible.
The 'No e-submission' flag, despite using an e-sourcing platform, might indicate a less formal electronic engagement process than a full tender.

Recommendations

1. Explicitly encourage suppliers to present innovative and sustainable solutions during the market engagement phase to inform future tender design.
2. Clarify the exact method of electronic engagement/submission for the PME on the e-sourcing platform.
3. Ensure future tender documents clearly integrate social value and environmental considerations, building on insights from this PME.
