Original Tender Description

THIS IS NOT A CALL FOR COMPETITION. THIS IS A MARKET ENGAGEMENT. Shropshire Council is currently conducting a Preliminary Market Engagement (PME) to gather insights and feedback from potential suppliers operating within the market. The purpose of this engagement is to identify the types of solutions and functionalities available for the procurement of Accommodation Based Care Services. This encompasses Care Homes and supported living, and may, through further engagement, extend to additional areas of provision. The framework aims to consider the opportunity for implementing a comprehensive solution that covers provision for all age groups. The Council has an established procurement approach for Care Home Placements through the ‘Approved Provider List’ (APL). Additionally, the FCA framework is in place for Learning Disabilities & Autism (LD&A). However, with the implementation of the Procurement Act 2023, the APL is no longer a viable option for procurement delivery. As a result, Shropshire Council is reviewing alternative models to ensure effective and compliant procurement of Accommodation Based Care Services in the future. Tender Quality Score

This is a clearly defined Preliminary Market Engagement (PME) aimed at gathering insights for future procurement models, aligning with new procurement legislation. The documentation is exceptionally clear and appropriate for a PME.

Score Breakdown

Legal Compliance90/100

The tender is explicitly defined as a Preliminary Market Engagement (PME), which is a compliant pre-procurement activity under the Procurement Act 2023. Deadlines are reasonable for market engagement, and the CPV code is appropriate. No disputes or suspensions are noted.

Clarity95/100

The documents are exceptionally clear, repeatedly stating that this is not a call for competition but a market engagement. This clarity extends to explicitly stating that formal bidding requirements (exclusion, eligibility, technical, financial, submission) are not applicable at this PME stage.

Completeness85/100

All essential information for a PME is provided, including title, organization, reference, purpose, estimated value, and duration. The explicit absence of formal tender requirements is appropriate for a PME and clearly communicated.

Fairness90/100

Full document access is provided via a link, and the estimated value is disclosed. As this is a PME, there are no specific requirements that could be tailored to a particular company. The use of an e-sourcing platform promotes equal access for engagement.

The field 'Value Classified: Yes' is present despite the estimated value being explicitly disclosed, which is a minor data inconsistency.
Practicality80/100

Engagement is facilitated through an e-sourcing platform (Delta), implying electronic interaction. The document URL, contract start date, and duration are clearly specified. Financing information is general (council funds), which is typical for a PME.

Data Consistency90/100

Data is largely consistent across the provided information. Minor inconsistencies, such as the empty 'Liable Person' field and the 'Value Classified: Yes' flag despite the value being disclosed, are not critical for a PME.

The 'Liable Person' field is empty.
The field 'Value Classified: Yes' is present despite the estimated value being explicitly disclosed.
Sustainability50/100

The tender documents do not explicitly mention green, social, or innovation criteria as part of the procurement process itself. While the service (care) is inherently social, the PME does not highlight these aspects for future procurement evaluation.

No explicit mention of green procurement criteria.
No explicit mention of social criteria for the procurement process.

Strengths

Explicitly and clearly defined as a Preliminary Market Engagement (PME).
Clear purpose: gathering insights for future procurement under the Procurement Act 2023.
All formal tender requirements are explicitly stated as not applicable at this PME stage.
Estimated value, duration, and contract start date are provided.
Utilizes an e-sourcing platform (Delta) for engagement.

Concerns

The 'Liable Person' field is empty.
The 'Value Classified: Yes' flag is present despite the estimated value being disclosed, which is a minor data inconsistency.
No explicit mention of green, social, or innovation criteria as part of the procurement process itself, beyond the inherent social nature of the service.

Recommendations

1. Ensure all administrative fields, such as 'Liable Person,' are populated for future notices, even for PMEs.
2. Clarify the 'Value Classified' flag if the value is explicitly disclosed to avoid potential confusion.
3. Consider explicitly inviting feedback on how sustainability, social value, and innovation could be integrated into the future procurement framework for these services during the market engagement phase.
