Original Tender Description

Pharmacy Procurement Contract - A ranked framework for the supply and delivery of Supply of Dose banded compounded chemotherapy split into 2 lots: Lot 1: Products - 7 molecules / all brands Lot 2: Products - 13 molecules / all brands The ranked framework will be open to the participating Trusts of the South East Pharmacy Procurement Service (SEPPS): Thames Valley and Wessex (TV&W) 1. Ashford and St Peters Hospital NHS Foundation Trust ... This framework will be available for use by Trusts in East of England and London regions, but the volumes for these regions have not been included for adjudication as part of the tender process. SEC Trusts can utilise this tender for products or services not covered by the National unlicensed aseptically prepared cytotoxic medicines and Dose banded compounded chemotherapy framework via MPSC. Please note: we did not publish a preliminary market engagement notice (UK2) for the following reasons: - we are not seeking to further develop our requirements or procurement approach. - we have procured similar supply arrangements via the Open procedure and deployed similar conditions of participation and award criteria. These have yielded good results previously. - we have already prepared our tender pack (see attached), that detail standard NHS contractual terms which have been found to be acceptable to the supply chain. - we understand the likely suppliers who will be interested but the open notice approach gives opportunity to others looking to enter the Dose banded compounded chemotherapy supply market

Tender Quality Score

This tender exhibits good legal compliance and data consistency but is significantly hampered by critical issues regarding clarity, completeness, and fairness due to inaccessible documents and missing evaluation criteria. Practicality is moderate, and sustainability aspects are largely absent.

Score Breakdown

Legal Compliance85/100

The tender clearly defines the open procedure and correctly assigns the CPV code. It acknowledges UK public procurement regulations regarding exclusion grounds and provides a rationale for not conducting preliminary market engagement, indicating awareness of legal requirements. No disputes are reported, and the submission period is reasonable.

Clarity55/100

The description of the framework, lots, and participating trusts is clear. However, a significant concern is the absence of specified evaluation criteria in the provided information, which is crucial for bidders to understand how their proposals will be judged. Only mandatory exclusion grounds are explicitly mentioned as requirements.

Missing evaluation criteria
Performance conditions not explicitly detailed in the provided text
Completeness50/100

Basic information like title, reference, organization, value, duration, and location (NUTS, list of trusts) is present. However, the tender is incomplete due to critical documents being inaccessible ('Page not found', 'Download failed'). Furthermore, the evaluation criteria, which are fundamental to a complete tender, are not specified in the provided content.

Inaccessible tender documents
Missing evaluation criteria
Fairness45/100

The tender uses an open procedure and discloses the estimated value, which promotes fairness. However, the lack of specified evaluation criteria severely impacts transparency and objectivity. Additionally, the inability to access all listed documents and the absence of electronic submission options create barriers and reduce equal access for all potential bidders.

Missing evaluation criteria
Inaccessible documents
Practicality60/100

The contract start date and duration are clearly specified, which is practical for planning. However, the lack of electronic submission is a significant practical drawback in modern procurement. The issues with document accessibility also pose practical challenges for bidders.

No electronic submission
Issues with document accessibility
Data Consistency90/100

Key fields such as title, reference, organization, value, deadlines, and duration are consistently populated and logical. There are no reported disputes or suspensions, and dates are coherent. Minor omissions like 'Liable Person' or specific procedure codes do not significantly impact overall consistency.

Minor omissions (Liable Person, procedure code)
Sustainability30/100

The tender does not explicitly mention any green procurement initiatives, social criteria, or innovation focus. It is also not EU funded, which often correlates with higher sustainability standards.

No explicit sustainability, social, or innovation criteria

Strengths

Clear description of the scope, lots, and participating entities.
Transparent disclosure of estimated value and contract duration.
Proper classification with CPV and NUTS codes.
Rationale provided for procurement approach (e.g., not publishing UK2 notice).
No reported disputes or suspensions.

Concerns

Critical tender documents are inaccessible or 'page not found'.
Evaluation criteria are not specified, impacting clarity and fairness.
Lack of electronic submission option.
Absence of explicit sustainability, social, or innovation considerations.
Only one AI-extracted requirement, suggesting limited detail in the provided text.

Recommendations

1. Ensure all tender documents are fully accessible and functional for potential bidders.
2. Clearly define and publish all evaluation criteria to ensure transparency and fairness.
3. Implement electronic submission capabilities to streamline the process and enhance accessibility.
