Original Tender Description

North Ayrshire Council ("NAC") are responsible for the procurement of service transport contracts to meet the education and social care needs of children and vulnerable adults as well as other passenger or transport requirements. Most of the transport will be within the North Ayrshire area, but there will also be cross-boundary requirements ranging beyond the North Ayrshire area. NAC is setting up a Dynamic Purchasing System (“DPS”) to procure these contracts. The DPS will be setup using the Restricted Procedure (with the caveat of no limit to the number of tenderers who qualify) and is open to any supplier who satisfies the selection criteria specified in this Contract Notice. A DPS is a completely electronic system and is similar to a framework agreement but a key difference is that, unlike a framework agreement, suppliers can join a DPS at any time. The DPS will commence on 1st April 2021 until 31st March 2027, with no option to extend. The DPS will be split into the following categories: Category 1 Wheelchair Accessible with Escort Category 2 Wheelchair Accessible without Escort Category 3 All Other Vehicle Types with Escort Category 4 All Other Vehicle Types without Escort Category 5 Ad Hoc Journeys Contracts operated through this DPS can generally be undertaken by taxis, private hire cars, minibuses, wheelchair accessible vehicles and non-plated vehicles.

Tender Quality Score

This tender establishes a Dynamic Purchasing System (DPS) for transport services, offering flexibility and continuous market access, which is a robust approach for ongoing needs. However, the critical absence of full tender documents, including detailed selection and award criteria, severely limits a comprehensive quality assessment and poses a significant barrier for potential suppliers.

Score Breakdown

Legal Compliance100/100

The use of a Dynamic Purchasing System (DPS) under the Restricted Procedure, with the caveat of no limit to qualified tenderers, aligns with public procurement regulations. The mention of mandatory exclusion grounds, even if not detailed in the extract, indicates awareness of legal requirements. No specific legal non-compliance is evident from the provided text.

Clarity40/100

The tender's description of the DPS, its purpose, categories, and required vehicle types is clear and well-structured. The eligibility and technical capability requirements, as extracted, are also generally understandable. However, the overall clarity for a potential bidder is severely hampered by the absence of the full tender documentation.

Completeness83/100

This is the most significant area of concern. The tender information provided is highly incomplete due to the explicit statement 'DOCUMENTS (0 total)' and 'No document content available'. Crucial elements such as the full Contract Notice, detailed selection criteria, award criteria, terms and conditions, and specific mandatory exclusion grounds are missing, making a full assessment impossible.

Critical absence of full tender documents.
Missing detailed selection criteria.
Fairness80/100

The DPS structure inherently promotes fairness by allowing new suppliers to join at any time and by stating 'no limit to the number of tenderers who qualify'. The categorization of services appears reasonable, allowing specialized providers to participate. Without the full selection and award criteria, however, a complete assessment of fairness in the evaluation process cannot be made.

Practicality40/100

The implementation of a DPS is highly practical for procuring ongoing, diverse transport services, allowing the contracting authority to adapt to market changes and new entrants. The categorization of services (e.g., wheelchair accessible, escorts, ad hoc) is practical for matching specific needs with supplier capabilities. The system being 'completely electronic' further enhances practicality.

Data Consistency100/100

The provided information is internally consistent. The DPS duration (2021-2027) aligns with the contract duration (72 months), and the description of services matches the defined categories and vehicle types. No contradictions were found within the extracted data.

Sustainability25/100

The tender explicitly lists 'Social Criteria' under procurement characteristics, which is a positive indicator for incorporating social sustainability aspects. However, no specific details on these criteria are provided, nor are there any explicit environmental sustainability requirements mentioned in the extract.

Lack of specific details regarding the 'Social Criteria'.
Absence of explicit environmental sustainability requirements.

Strengths

Effective use of a Dynamic Purchasing System (DPS) for flexibility and continuous market access.
Clear categorization of services, allowing for specialized supplier participation.
Explicit mention of 'Social Criteria' as a procurement characteristic.
Openness to all qualified suppliers with no limit on tenderer numbers.
Clear description of the overall scope, purpose, and required vehicle types.

Concerns

Critical absence of full tender documents, including the Contract Notice and detailed terms.
Lack of specified selection and award criteria, hindering transparency and bidder preparation.
Mandatory exclusion grounds are mentioned but not detailed in the provided extract.
No explicit environmental sustainability requirements are detailed.
No indication of requirements being tailored for a specific company was detected based on the provided information.

Recommendations

1. Ensure all comprehensive tender documents, including the full Contract Notice, detailed selection criteria, and award criteria, are readily available to potential suppliers.
2. Clearly articulate specific social criteria and consider integrating measurable environmental sustainability requirements into the tender documents.
3. Provide clear guidance on the electronic system for joining the DPS and participating in subsequent mini-competitions.
