Original Tender Description

The Council wishes to purchase twenty (20) Air Quality Sensors. The Sensors are to be deployed across the City of Leicester to measure and monitor air quality at various hotspots that have potential poor air quality. The requirement under this specification will allow the Council to be informed of where the Council should focus its initiatives and assess the effectiveness of its existing air quality monitoring work. The contract has not been split into lots. Dividing the requirement would increase the risk of data security issues and a higher potential for data loss. In addition, it would introduce unnecessary complexity in contract management. A Preliminary Market Engagement (PME) exercise was undertaken to inform the development of this procurement. Suppliers were invited to respond to the Council’s PME questionnaire. Eight (8) suppliers submitted responses, of which five (5) were shortlisted and invited to demonstrate their solutions. Four (4) of the shortlisted suppliers delivered demonstrations via Microsoft Teams. Suppliers were provided with an agenda in advance of the demonstration sessions, and discussions were structured around the agreed agenda items. The outcomes of the PME, including the questionnaire document and the demonstration agenda, are included within the tender pack for further detail. The Preliminary Market Engagement Notice for this requirement was published on 25 June 2025 and can be found at the following link: https://www.find-tender.service.gov.uk/Notice/035198-2025?

Tender Quality Score

This tender demonstrates good preliminary market engagement and a clear objective, but critically lacks essential documentation, including mandatory exclusion grounds, eligibility requirements, and evaluation criteria, making it incomplete and potentially unfair.

Score Breakdown

Legal Compliance100/100

Legal compliance is severely compromised by the absence of mandatory exclusion grounds, eligibility requirements, and, most critically, evaluation criteria. These are fundamental requirements for an open public procurement procedure.

No specific mandatory exclusion grounds provided.
No specific eligibility requirements provided.
Clarity40/100

The tender's description of the requirement and the rationale for not splitting into lots are clear. The PME process is also well-described. However, the overall clarity for bidders is severely hampered by the absence of the full tender documentation and detailed specifications.

Lack of full tender documentation (e.g., detailed specifications, draft contract) reduces overall clarity for bidders.
Completeness83/100

The tender is critically incomplete due to the absence of the full tender pack, including detailed technical specifications, mandatory exclusion grounds, eligibility requirements, and evaluation criteria. The NUTS code is also listed as N/A, which is unusual for a specific council.

No documents attached or content available for the full tender pack.
Missing detailed technical specifications for the sensors and associated services.
Fairness60/100

While the Preliminary Market Engagement suggests an effort towards market understanding, the absence of mandatory exclusion grounds, eligibility requirements, and evaluation criteria fundamentally undermines the fairness and transparency of the tender process. Bidders cannot adequately prepare or understand the basis of selection.

Absence of mandatory exclusion grounds, eligibility requirements, and evaluation criteria compromises fairness.
CPV code 'Software package and information systems' may be too broad or inaccurate for physical air quality sensors and associated services, potentially misdirecting suppliers.
Practicality40/100

The core requirement for air quality monitoring is practical, and the contract duration is reasonable. However, the lack of detailed technical specifications makes it impractical for bidders to formulate precise and compliant proposals. The absence of e-submission is also a practical drawback.

Lack of detailed technical specifications makes it difficult for bidders to propose precise solutions.
No e-submission option, which is a practical drawback in modern procurement.
Data Consistency100/100

The provided information is internally consistent regarding the number of sensors and the rationale for a single lot. However, the overall lack of comprehensive data (missing documents) prevents a thorough assessment of consistency across all tender elements.

Sustainability25/100

There is a significant missed opportunity to integrate green procurement and social criteria, especially given the environmental focus of the tender. This is a notable weakness in modern public procurement practices.

No green procurement criteria specified.
No social criteria specified.

Strengths

Clear description of the core requirement and purpose.
Proactive Preliminary Market Engagement (PME) undertaken.
Rationale provided for not splitting the contract into lots.
Innovation focus indicated.
Estimated value disclosed and reasonable contract duration.

Concerns

Critical absence of essential tender documentation (full tender pack, detailed specifications, draft contract).
Missing mandatory exclusion grounds, eligibility requirements, and evaluation criteria.
Potentially incorrect or overly broad CPV code ('Software package and information systems').
Missed opportunity to integrate green and social procurement criteria.
No e-submission option.

Recommendations

1. Immediately publish the complete tender documentation, including detailed specifications, draft contract, mandatory exclusion grounds, eligibility criteria, and clear evaluation criteria.
2. Review and potentially update the CPV code to better reflect the nature of the goods and services being procured.
3. Integrate green and social procurement criteria into the tender, aligning with best practices for public procurement, especially for an environmentally focused project.
