Original Tender Description

Falkirk Council are seeking to invite Passenger Vehicle Operators to participate in a Dynamic Purchasing System (DPS) which will be used to procure transport related "service contracts" operated by Public Service Vehicles (PSV) including subsidised local bus services, home to school transport, and other education transport. It is anticipated that the DPS will run for a period of 10 years and that mini-competitions will be run under it. Organisations applying for this DPS should note that in some circumstances there will not be a minimum of 10 days given to respond to mini-competitions.

Tender Quality Score

This tender for a Dynamic Purchasing System (DPS) for bus services outlines a clear scope and duration, but suffers from a critical lack of detailed documentation and specific requirements, raising significant concerns about transparency and fairness.

Score Breakdown

Legal Compliance100/100

The use of a Dynamic Purchasing System (DPS) is a legally valid procurement procedure. However, the absence of explicitly stated mandatory exclusion grounds in the provided information is a procedural oversight, even if implied by national law. More critically, the complete lack of evaluation criteria for both DPS admission and subsequent mini-competitions is a major legal compliance issue, as it undermines the principles of transparency and equal treatment.

No explicit mandatory exclusion grounds stated.
Missing evaluation criteria for DPS admission and mini-competitions.
Clarity40/100

The overall purpose of the DPS, the types of services sought, and the long contract duration are clearly communicated. The warning about potentially short response times for mini-competitions is also explicit. However, the clarity of what is specifically required from potential operators (e.g., detailed technical capabilities, financial standing) is extremely low due to the absence of comprehensive tender documents.

Lack of detailed requirements for eligibility, technical capability, and financial standing.
Completeness83/100

This tender is severely incomplete. The most significant issue is the complete absence of any attached tender documents, meaning all detailed instructions, specifications, and forms are missing. Key missing elements include specific financial requirements (e.g., minimum turnover, insurance), detailed technical specifications (e.g., fleet standards, driver qualifications), and crucially, the methodology and criteria for evaluating applications and mini-competition bids.

No tender documents attached or content available.
Missing detailed financial requirements.
Fairness80/100

The lack of detailed requirements and, most importantly, the absence of explicit evaluation criteria for both DPS admission and mini-competitions create significant fairness concerns. Without clear, objective criteria, the process for selecting operators could be perceived as arbitrary or subjective, potentially disadvantaging certain bidders. The broad and vague nature of the eligibility and technical requirements (e.g., 'Must be capable of providing...') further exacerbates this issue.

Absence of clear and objective evaluation criteria for DPS admission and mini-competitions.
Vague and broad eligibility and technical requirements, potentially leading to subjective assessment.
Practicality40/100

The use of a DPS is practical for procuring ongoing transport services over a long period, allowing for market flexibility and new entrants. However, the current lack of detailed requirements could lead to a high volume of unqualified applications, increasing the administrative burden for the contracting authority. For bidders, the absence of clear thresholds makes it difficult to self-assess suitability, potentially discouraging participation or leading to wasted effort.

Lack of detailed requirements may lead to a high volume of unqualified applications.
Difficulty for bidders to self-assess suitability due to vague requirements.
Data Consistency100/100

The provided basic information (title, reference, organization, value, duration) is internally consistent. The extracted requirements align with the general description of the DPS and its purpose.

Sustainability0/100

There is no mention of green procurement, social criteria, or innovation focus within the provided information. For a 10-year contract of this value and nature, this represents a missed opportunity to integrate sustainability objectives.

No mention of green procurement criteria.
No mention of social criteria.

Strengths

Utilizes a Dynamic Purchasing System (DPS) for flexibility and continuous market access.
Clear scope of services (local bus, education transport) and long contract duration (10 years).
Estimated value is disclosed, providing transparency on the scale of the opportunity.

Concerns

Critical absence of any tender documents, making detailed assessment impossible.
Lack of specific and measurable eligibility, technical, and financial requirements.
Complete absence of evaluation criteria for both DPS admission and mini-competitions, raising fairness and transparency issues.
No explicit mandatory exclusion grounds stated in the tender information.

Recommendations

1. Immediately publish comprehensive tender documents detailing all requirements, selection criteria, and evaluation criteria for both DPS admission and subsequent mini-competitions.
2. Clearly define specific, measurable financial and technical requirements to ensure qualified operators are admitted to the DPS.
3. Explicitly state mandatory exclusion grounds and refer to relevant legal provisions.
