Original Tender Description

NHS London Procurement Partnership is establishing a Dynamic Purchasing System (DPS) to provide a compliant procurement route for Waste Management Services to the NHS and other public sector organisations. This will encompass Collection, transport, treatment, recycling, processing and disposal as appropriate, of healthcare and general waste including domestic, recyclable, clinical, hazardous, offensive, pharmaceutical, toxic, radioactive and biological waste streams. The DPS will be split into lots to include specific waste streams, integrated waste management and bespoke treatment options. See documentation for full details, NHS LPP may add further specialist lots later in the lifetime of the DPS. This will be determined by the needs of our membership and the development of the market. It is not possible at this stage to precisely define all possibilities however. The DPS will cover all regions in England and the wider UK - see documentation for details.

Tender Quality Score

This tender establishes a large-scale Dynamic Purchasing System for waste management across the UK public sector, demonstrating a strategic approach to procurement. However, the complete absence of tender documents and detailed requirements significantly hinders a comprehensive assessment of its quality and fairness.

Score Breakdown

Legal Compliance100/100

The tender correctly identifies mandatory exclusion grounds, which is a standard legal requirement. However, without access to the full tender documentation, it is impossible to verify full compliance with all UK public procurement regulations regarding transparency, competition, and detailed process steps.

Lack of full tender documentation prevents comprehensive legal compliance verification.
Clarity40/100

The general description of the DPS scope, waste streams, and geographical coverage is clear. However, the complete absence of any attached documents means that specific requirements, lot structures, technical specifications, and operational details are entirely undefined, leading to extreme lack of clarity for potential bidders.

Complete absence of specific requirements and technical specifications due to missing documents.
Lack of detailed lot structure information.
Completeness83/100

The tender information provided is severely incomplete. While basic administrative details are present, the critical absence of any tender documents (0 total) means that essential information such as detailed scope, terms and conditions, evaluation criteria, submission instructions, and contract particulars are entirely missing.

No tender documents attached.
Missing evaluation criteria.
Fairness80/100

The DPS structure itself is designed to promote fairness by allowing new entrants throughout its lifetime. However, the complete lack of detailed requirements, specifications, and evaluation criteria makes it impossible to assess if the tender is genuinely fair and non-discriminatory in practice. Without these details, there's a risk of subjective assessment or tailoring during subsequent mini-competitions.

Inability to assess fairness due to missing detailed requirements and evaluation criteria.
Potential for subjective assessment in subsequent mini-competitions without clear upfront criteria.
Practicality40/100

From a bidder's perspective, it is currently impractical to prepare a meaningful submission as there are no documents outlining what is required. The tender, in its current state, serves only as an announcement without actionable content for participation.

Impossible for bidders to prepare a submission without any tender documents.
Lack of e-submission details (as flagged by automated check).
Data Consistency100/100

Given the extremely limited data provided, there are no apparent inconsistencies. However, the lack of detailed documentation means there is insufficient information to perform a thorough consistency check.

Sustainability25/100

The tender mentions 'Innovation Focus,' which can contribute to sustainability. However, the automated check explicitly flags 'Not green procurement' and 'No social criteria.' Without specific requirements in the missing documents, there's no evidence of concrete sustainability or social value considerations being integrated into the procurement.

Lack of explicit green procurement requirements.
Absence of social criteria.

Strengths

Strategic use of a Dynamic Purchasing System (DPS) for long-term flexibility and market access.
Clear identification of a broad range of waste streams and geographical coverage.
Significant estimated value indicating a major strategic procurement.
Explicit mention of 'Innovation Focus'.

Concerns

Complete absence of any tender documents, making the tender non-actionable.
Missing detailed requirements, technical specifications, and lot structures.
Lack of evaluation criteria, hindering transparency and fairness.
Inability for bidders to prepare a meaningful submission.
Absence of explicit green procurement and social criteria, despite the 'Innovation Focus'.

Recommendations

1. Immediately publish all essential tender documents, including detailed specifications, lot descriptions, terms and conditions, and evaluation criteria.
2. Clearly define how 'Innovation Focus' will be assessed and integrated into the DPS and subsequent call-offs.
3. Integrate explicit green procurement and social value criteria into the tender documentation to align with modern public procurement best practices.
