Original Tender Description

WME invites suppliers to join an Open Framework for energy efficiency improvements, primarily Solar PV installation, in public sector buildings (e.g., schools, council buildings). This expands WME's decarbonisation services. Barker Associates, WME's decarbonisation partner, supported framework establishment and will use it to call off contracts, including ITT preparation and technical support. Contracting Authorities may use their own advisors. For the first 12 months, WME's fully managed procurement service will only be available to authorities using Barker Associates' consultancy, to resolve initial issues. More information and response options are on the Delta eSourcing portal.

Tender Quality Score

This tender for solar PV and energy efficiency works has a clear objective but is severely hampered by inaccessible documents and significant fairness concerns regarding a named consultant's involvement and preferential treatment.

Score Breakdown

Legal Compliance50/100

The tender faces significant legal compliance risks due to the inaccessibility of 60% of its documents, which hinders transparency and equal access to information. Furthermore, the explicit involvement of Barker Associates in drafting the tender and their preferential position for the first 12 months raises serious questions about adherence to principles of equal treatment and non-discrimination in public procurement.

6 out of 10 tender documents are inaccessible ('Page not found').
Potential conflict of interest and unequal treatment due to Barker Associates' involvement in drafting and initial preferential role.
Clarity40/100

While the overall objective is clear, the tender lacks clarity on critical details. Specific mandatory exclusion grounds, eligibility, financial requirements, and crucially, evaluation criteria are not detailed in the provided summary, and the inaccessible documents prevent further understanding.

Missing specific evaluation criteria.
Lack of detailed eligibility, financial, and exclusion requirements in the provided summary.
Completeness30/100

Fairness20/100

Fairness is severely compromised. The inaccessibility of most tender documents creates an unequal playing field. More critically, the explicit statement that Barker Associates, a single supplier framework holder, helped draft this tender and will exclusively manage initial call-offs for 12 months, indicates a significant conflict of interest and preferential treatment, undermining open competition.

Significant conflict of interest and preferential treatment for Barker Associates.
6 out of 10 tender documents are inaccessible, preventing equal access to information.
Practicality60/100

Electronic submission is supported via Delta eSourcing, and key dates are provided. However, the practical ability for suppliers to prepare a compliant bid is severely hindered by the inaccessibility of the majority of the tender documents, making it difficult to understand the full scope and requirements.

6 out of 10 tender documents are inaccessible, making practical preparation difficult.
Data Consistency85/100

Most key fields are populated, and dates are logical and consistent. Minor inconsistencies include missing codes for the procedure type, but overall, the structured data is reliable.

Missing codes for 'Type' and 'Procedure'.
Sustainability70/100

The tender's core focus on Solar PV and energy efficiency inherently contributes to environmental sustainability (green procurement). However, there is no explicit mention of broader social aspects or innovation focus beyond the primary service offering.

No explicit mention of social criteria.
No explicit innovation focus.

Strengths

Clear overall objective for decarbonisation and energy efficiency.
High estimated value, indicating a significant opportunity.
Electronic submission supported via Delta eSourcing portal.
Contract duration and start date are clearly specified.
Framework is divided into parts, potentially encouraging broader participation.

Concerns

Significant conflict of interest and preferential treatment for Barker Associates.
6 out of 10 tender documents are inaccessible ('Page not found').
Missing specific evaluation criteria.
Lack of detailed eligibility, financial, and exclusion requirements in the provided summary.
Missing procedure codes for 'Type' and 'Procedure'.

Recommendations

1. Immediately rectify the issue of inaccessible tender documents to ensure full transparency and equal access for all potential bidders.
2. Address the conflict of interest concerning Barker Associates to ensure fair and equal treatment of all suppliers, potentially by revising the 12-month exclusivity clause or providing a clear justification for its necessity and compliance with procurement principles.
3. Publish detailed evaluation criteria, mandatory exclusion grounds, and specific eligibility/financial requirements to enhance clarity and transparency.
