Ursprüngliche Ausschreibungsbeschreibung

On 5 August 2022, arc21 published notice 2022/S 000-021639 (the "Notice") concerning the establishment of arc21's Dynamic Purchasing System (DPS) for its ongoing requirement for the supply of services relating to the Treatment and Energy Recovery/Disposal of Residual Waste Arisings. The DPS was initially established on 27 October 2022. The period of validity stated in the Notice was for an initial period of 48 months (i.e. until 27 October 2026), but the Notice stated that the DPS was anticipated to remain live for a further 48 months after this. The purpose of this notice is to record that the period of validity of the DPS has been changed by extending the period of validity to 23 February 2029 (so that the period of validity of the DPS is from 27 October 2022 to 23 February 2029). The DPS is divided into four (4) Lots, for the provision of services relating to the treatment and energy recovery or disposal of Member Councils' residual waste arisings: Lot 1 predominantly incorporates residual kerbside collections and residual waste from commercial/trade collections, which may be mixed with other residual waste streams. Lot 2 predominantly incorporates residual waste from Household Waste Recycling Centres which may be mixed with other residual waste streams. Lot 3 predominantly incorporates combined residual kerbside waste from commercial/trade collections and Household Waste Recycling Centre waste which may be mixed with other residual waste streams. Lot 4 predominantly incorporates other residual waste streams such as street litter, bulky waste and fly tipped waste and which may include waste arising from bonfires that has not or cannot be combined in any of the Lots. Within each of the Lots there may also be a requirement for the Contractor(s) to provide a delivery point(s) within a specified range; the loading of waste and/or an element of waste transport. The DPS is a two-stage process. There is no intention to limit the minimum and maximum number of service providers. The DPS will be open to entrants, throughout its life, who meet the minimum criteria. Further information on the selection process can be found within the procurement documents. In addition to the specific Participating Bodies detailed in the notice, Call-Off Competitions may include waste from NI Councils who are not constituent councils of arc21. For previous information regarding this DPS, please refer to the original Contract Notice reference: 2022/S 000-021639, https://www.find-tender.service.gov.uk/Notice/021639-2022? For the avoidance of doubt, Economic Operators that have already had Applications accepted under the DPS do not need to respond to this Contract Notice as they are already admitted to the DPS under their respective Lots.

Qualitätsbewertung der Ausschreibung

This tender notice extends an existing Dynamic Purchasing System for waste management services, providing clear details on the extension and lot structure, but suffers from some documentation inconsistencies and a lack of explicit detail on all mandatory requirements and evaluation criteria within the immediate notice.

Bewertungsaufschlüsselung

Rechtliche Konformität75/100

The tender generally complies with legal requirements, providing essential information and referencing the original notice. However, the classification as 'Restricted procedure' for a DPS extension is formally inconsistent, and the presence of an irrelevant document (Document 1) in the package is a concern. Mandatory exclusion grounds and financial requirements are noted as not explicitly stated in the AI summary, though they should be in the full procurement documents.

•Inconsistent procedure classification ('Restricted' for a DPS extension)
•Irrelevant document included in the tender package (Document 1)
Klarheit80/100

The description of the DPS extension, its purpose, and the division into lots is very clear and unambiguous. The AI-extracted requirements are understandable, but the absence of explicit evaluation criteria for admission or call-off contracts in the provided text reduces overall clarity for potential applicants.

•Evaluation criteria for DPS admission or call-off contracts are not explicitly detailed in the provided text
Vollständigkeit70/100

Basic information, value, and duration are well-specified. However, the inclusion of an entirely irrelevant document (Document 1) significantly impacts completeness. Furthermore, explicit financial requirements and comprehensive evaluation criteria are not detailed in the provided text, requiring reference to external documents.

•Irrelevant document included in the tender package (Document 1)
•Financial requirements not explicitly stated in the provided text/AI summary
Fairness85/100

The Dynamic Purchasing System (DPS) structure inherently promotes fairness by allowing continuous admission of qualified suppliers without limiting their number. The value is disclosed, and e-procurement is enabled. Requirements appear generic and not tailored. The main transparency concern is the lack of explicit evaluation criteria in the immediate notice.

•Evaluation criteria for DPS admission or call-off contracts are not explicitly detailed in the provided text
Praktikabilität65/100

Electronic submission is indicated, and a URL to the original notice is provided, enhancing accessibility. However, the presence of an irrelevant document and the need to consult external documents for full financial and exclusion criteria details reduce the immediate practicality for a comprehensive assessment.

•Irrelevant document included in the tender package (Document 1)
•Full financial and exclusion criteria require reference to external documents
Datenkonsistenz90/100

Most key fields are populated, and dates are logical and consistent with the DPS extension. Minor inconsistencies include an empty 'Liable Person' field and the 'Restricted' procedure type conflicting with the nature of a DPS.

•Empty 'Liable Person' field
•Inconsistent procedure classification ('Restricted' for a DPS extension)
Nachhaltigkeit50/100

While the tender concerns waste management, which has inherent environmental aspects, the notice does not explicitly incorporate specific green procurement criteria, social considerations, or an innovation focus. This represents a missed opportunity for a high-value, long-term contract.

•No explicit green procurement criteria
•No explicit social aspects

Stärken

Clear description of the DPS extension and lot structure
High estimated value disclosed, promoting transparency
Dynamic Purchasing System (DPS) structure allows continuous supplier admission, enhancing market access
E-Procurement enabled for submission
Reference to original contract notice provided

Bedenken

Inclusion of an irrelevant document (Document 1) in the tender package
Lack of explicit evaluation criteria for DPS admission or call-off contracts in the provided text
Mandatory exclusion grounds and financial requirements not explicitly detailed in the provided text/AI summary
Inconsistent procedure classification ('Restricted' for a DPS extension)
Absence of explicit sustainability (green, social, innovation) criteria

Empfehlungen

1. Ensure all attached documents are relevant and accurate to avoid confusion and maintain integrity.
2. Clearly outline the evaluation criteria for DPS admission and refer to where call-off contract criteria will be specified.
3. Explicitly state mandatory exclusion grounds and financial requirements within the primary tender notice or clearly signpost their location in the full procurement documents.
